Abstract

Saat ini Indonesia memasuki era globalisasi yang ditandai dengan perubahan tingkah laku maupun perbuatan hukum masyarakatnya, salah satu contohnya adalah timbulnya perbuatan hukum transaksi yang dilakukan secara elektronik. Notaris sebagai pejabat penyelenggara pelayanan publik juga tengah berusaha mengaplikasikan sistem berbasis elektronik dalam menjalankan tugas jabatannya, diluar kewenangannya sebagai pembuat akta autentik, grosse, salinan akta, dan kutipan akta. Peluang ini semakin luas dengan dikeluarkannya UU Nomor 2 Tahun 2014 sebagai perubahan UU Nomor 30 Tahun 2004 tentang Jabatan Notaris yang memungkinkan penerapan fungsi notaris berbasis elektronik atau cyber notary. Dengan menjadikan Notaris sebagai cyber notary, maka Notaris bertindak sebagai penyelenggara transaksi elektronik. Penyelenggaraan transaksi elektronik secara lebih detail diatur oleh Peraturan Pemerintah No 71 Tahun 2019 tentang Penyelenggaraan Sistem dan Transaksi Elektronik namun dalam prakteknya Notaris masih ragu karena ditakutkan berbenturan dengan peraturan mengenai wilayah jabatan Notaris yang diatur dalam Pasal 17 huruf a jo. Pasal 18 UUJN maka tugas akhir ini mencoba mengidentifikasi mengenai pelaksanaan kewenangan Notaris sebagai cyber notary dikaitkan dengan pengaturan tentang wilayah jabatan Notaris. / Nowadays, Indonesia has entered the era of globalization which is marked by changes in behavior and legal actions of its people, one example is the emergence of electronic legal transactions.Notary, as an official public service provider currently applying electronic based system in carrying out its duties outside Notary’s authority as the maker of authentic deeds, grosse, copy of the deed, and quote deed. With the issuance of Law Number 2 of 2014 as a change to Law Number 30 of 2004 concerning the Position of Notary that allows the application of electronic or cyber-based notary functions, these will boost the oportunity for conventional notary activities to be more electronic based. As a Cyber Notary, the Notary will act as the organizer of the electronic transaction. The implementation of electronic transactions in more detail is regulated by Government Regulation number 71 of 2009 concerning Operation of the System and Electronic Transactions, but in practice the Notary is still doubtful because it is feared to be colliding with regulations regarding the area of the Notary's position regulated in Article 17 Letter a juncto Article 18 UUJN (the notarial law). Hence, this thesis tries to identify the implementation of the authority of a Notary Public as a Cyber Notary related to the regulation of the position of the Notary’s territory.
