Abstract

Sertipikat hak atas tanah merupakan tanda bukti kepemilikan orang atas tanah. Permasalahan timbul ketika terdapat dua sertipikat di atas tanah yang sama, sehingga mengakibatkan ketidakpastian hukum pihak mana yang berhak atas tanah tersebut sebagaimana yang terjadi pada penerbitan 2 (dua) Sertipikat oleh Kantor Pertanahan Kota Padang. Penelitian ini menggunakan metode yuridis normatif dengan pengumpulan data yang digunakan adalah data sekunder. Hasil dari penelitian ini bahwa Perlindungan hukum terhadap pembeli beritikad baik atas tanah bersertipikat hak guna bangunan yang dibatalkan oleh putusan pengadilan adalah secara preventif, yaitu Zainirman selaku pembeli beritikad baik terlindungi oleh Pasal 35 Undang-Undang Tentang Pertanahan dan Pasal 25 ayat (1) Peraturan Pemerintah Nomor 40 tahun 1996 tentang Hak Guna Usaha, Hak Guna Bangunan dan Hak Pakai, sehingga Zainirman dapat melakukan kegiatan usaha di atas tanah tersebut, atau setidaknya memanfaatkannya untuk keperluan lain seperti penjaminan dalam rangka memperoleh pinjaman dari bank. Secara represif, dapat dilakukan melalui gugatan perdata ke pengadilan negeri. Masih terdapatnya sengketa tanah seperti tumpang tindih sertipikat hak atas tanah di Indonesia merupakan akibat dari sistem pendaftaran tanah di Indonesia yang menganut sistem publikasi negatif yang bertendensi positif, sehingga negara tidak menjamin kepastian hukum baik kepada pemegang sertipikat, maupun pihak ketiga yang memperoleh hak atas tanah. Upaya hukum yang dapat dilakukan oleh pembeli beritikad baik dalam memperoleh hak-haknya setelah Sertipikat Hak Guna Bangunannya dibatalkan oleh pengadilan adalah secara non yudisial dapat melakukan mediasi. Namun apabila mediasi tersebut gagal, maka bagi pihak Zainirman yang tidak mendapatkan manfaat atas tanah yang telah dibelinya dengan itikad baik, dapat melakukan upaya hukum lain melalui gugatan perdata, baik gugatan Perbuatan Melawan Hukum kepada ahli waris Buchari, Pejabat Pembuat Akta Tanah Ja’far Sarjana Hukum dan Kantor Pertanahan Kota Padang, maupun gugatan wanprestasi kepada ahli waris Buchari. / Land certificate is a proof of ownership of land. Problems arise when there are two certificates on the same land, resulting in legal uncertainty which party is entitled to the land as happened in the issuance of 2 (two) Certificates by the Padang City Land Office. This research uses normative juridical methods with the data collection used is secondary data. The results of this research that the legal protection of buyers in good faith over land with title to building rights canceled by a court ruling is preventive, namely Zainirman as the buyer of good faith is protected by Article 35 of the Law on Land and Article 25 paragraph (1) Government Regulation Number 40 of 1996 concerning Land Use Rights, Building Use Rights and Use Rights, so that Zainirman can carry out business activities on the land, or at least use it for other purposes such as guarantees in order to obtain loans from banks. Repressively, it can be done through a civil suit to the district court. The persistence of land disputes such as overlapping land title certificates in Indonesia is a result of the land registration system in Indonesia which adopts a negative publication system that has a positive tendency, so that the state does not guarantee legal certainty to certificate holders, or third parties who obtain land rights. Legal remedies that can be carried out by the purchaser in good faith in obtaining his rights after the Building Use Certificate has been canceled by the court is non-judicially able to mediate. However, if the mediation fails, then for Zainirman who does not get the benefit of the land he has bought in good faith, can make other legal remedies through a civil lawsuit, both the lawsuit against the law to the heirs of Buchari, Acting Author of the Ja'far Bachelor Land Act The Law and Land Office of Padang City, as well as the breach of lawsuit against Buchari's heirs.
