Abstract

Financial Services Authority (FSA) which is created based on the Law of the Republic of Indonesia Number 21 of 2011 concerning Financial Services Authority is an independent institution which takes over the function and role of Bank Indonesia and Indonesia Capital Market and Financial Institution Supervisory Agency (Bapepam-LK). This thesis focuses on how the regulation and supervision of FSA upon financial services institution which is in essence a continuation from the activity of regulation and supervision upon financial services institution which was previously conducted by Bank Indonesia and Bapepam-LK The problems emphasized in this thesis are (1) How is the role of FSA in performing regulatory and supervisory duty on financial institutions in accordance with Law No. 21 of 2011?; (2) How is the implementation from the function of regulation and supervision conducted by FSA in accordance with Law No. 21 of 2011. Based on the result of research, it shows that FSA conducts regulation and supervision in microprudential banking, capital market, insurance, financing institution, pension funds aspects, which all of those are related to the articles regulated in Law No. 21 of 2011. Therefore, the role of FSA has been regulated and is consistent with Law No. 21 of 2011 and the implementation under the function of regulation and supervision is in accordance with Law No. 21 of 2011 and is independent.
