Abstract

Dalam menjalankan tugas dan jabatannya sebagai Notaris, Notaris memiliki kewajiban dan kewenangan sebagaimana diatur di dalam Undang-Undang Jabatan Notaris, Kode Etik Notaris Kongres Luar Biasa Ikatan Notaris Indonesia Banten, 29-30 mei 2015, beserta peraturan perundang-undangan lainnya yang mempunyai keterkaitan dengan jabatan Notaris. Untuk melindungi Notaris dan masyarakat yang menggunakan jasa Notaris terkait kepastian hukum dari akta yang dibuat oleh Notaris, Dewan Kehormatan Pusat Ikatan Notaris Indonesia mengeluarkan Peraturan Dewan Kehormatan Pusat Nomor 1 Tahun 2017 Tentang Batas Kewajaran Jumlah Pembuatan Akta Perhari. Didalam peraturan tersebut, Dewan Kehormatan Pusat menentukan bahwa batas kewajaran dalam pembuatan akta per hari adalah sebanyak 20 (dua puluh) akta. Namun dalam Undang Undang Jabatan Notaris belum pernah mengatur secara spesifik mengenai batasan kewajaran pembuatan Akta Perhari, sehingga perlu dilakukan sebuah kajian yuridis untuk menjelaskan Keberlakuan dari Peraturan Dewan Kehormatan Pusat Ikatan Notaris Indonesia Nomor 1 Tahun 2017 bila dikaitkan dengan Undang-Undang Jabatan Notaris. Penulis melakukan pengumpulan data yang dilakukan dengan menggunakan pendekatan yuridis normatif dan dengan data sekunder. Pendekatan penelitian dilakukan dengan penelitian terhadap asas-asas hukum dalam hukum positif dengan analisa data secara kualitatif./ In carrying out his duties and position as a Notary, Notary in performing its duties and positions have an obligation and had a authority as manageable in Law Number 2 Year 2014 About Position Of Notary, Notary Ethic Code , Extraordinary Congress Indonesia Notary Knot Banten 29-30 May 2015 and then another regular law which have related with Notary position. To protect the Notary Public Offices and the people who use Notary services related to the legal certainty of the deed made by the Notary, the Central Board of Trustees of the Indonesian Notaries Association issued the Regulation of the Central Board of Honor No. 1 of 2017 on the Fairness Limit of Number of Permanent Deeds. The regulation is determined by the Central Board of Trustees that the limit of fairness in the deed per day is 20 (twenty) deeds. However in Law Number 2 Year 2014 About Position Of Notary never been specifically regulated about the the Fairness Limit of Number of Permanent Deeds. So it must be cleared by a juridical research to explain the Applicability of the Regulation of the Central Board of Honor No. 1 of 2017 when linked with Law Number 2 Year 2014 About Position Of Notary. In this research, author do a data collection conducted by using normative juridical approach and with primary data along with secondary data. The research approach is done by research on legal synchronization with qualitative data analysis.
