Abstract

Tujuan penelitian ini adalah untuk menjawab rumusan masalah berikut ini : apa yang menyebabkan tumpang tindihnya lahan dalam studi kasus ini dan bagaimana menyelesaikan konflik / sengketa menurut Peraturan Kepala Badan Pertanahan Nasional Nomor 11 Tahun 2016 berkenaan dengan jual beli tanah hak milik adat dengan tanah bersertifikat PRONA, serta bagaimana menyelesaikan masalah tersebut berdasarkan penelitian lapangan. Dalam menjawab rumusan masalah tersebut penulis menggunakan pengumpulan data melalui dokumentasi dan wawancara. Metode ini digunakan untuk menggambarkan penyelesaian transaksi jual beli tersebut antara tanah hak milik adat dengan tanah bersertifikat PRONA. Kemudian penulis melakukan analisa dengan menggunakan metode induktif yang dimulai dari pencarian fakta – fakta yang spesifik dari hasil penelitian lapangan baru kemudian dianalisa dengan menurut Peraturan Kepala Badan Pertanahan Nasional Nomor 11 Tahun 2016, dan dari analisa tersebut didapatkanlah kesimpulan secara umum. Hasil studi kasus ini menyimpulkan bahwa solusi yang terbaik adalah dengan bermusyawarah dengan semua pihak yang terlibat. Dengan cara tersebut diharapkan menciptakan solusi yang menguntungkan bagi masing semua pihak dan mehindari kasus ini untuk dibawa ke pengadilan yang akan menghasilkan keputusan yang menguntungkan hanya salah satu pihak saja dan mengakibatkan pihak lainya yang dirugikan merasa berat untuk melaksanakan hasil keputusan pengadilan tersebut, walau tanah mereka berbatasan langsung. / This study main purpose is to answer the following questions: what cause of land overlapping in this case study and how to solve the conflict according to Land Ministry Regulation No.11 Year 2016 regarding the sale and purchase of land of a unregistered land that overlap with the government registered land? And how to complete the sale and purchase of unregistered land that overlap with the government registered land (Case Study in Selaraja Village, Warunggunung District, Lebak Regency, Banten Province) based on field research. In answering those questions, the authors use data collection techniques through documentation and interviews. This method is used to describe the completion of the sale and purchase of unregistered land overlapped with govermnent registered land (Case Study in Selaraja Village, Warunggunung District, Lebak Regency, Banten Province) as the object of study. Then the author analyzed using the inductive method that begins with the facts that are specific from the results of existing research in the field, then analyzed using Land Ministry Regulation No.11 Year 2016, and from the analysis we can make a general conclusion. The results of the study concluded that the best solution in resolving the problem of unregistered land overlapped with govermnent registered land is to negotiate with all parties involved.This way it is expected to create a solution that is beneficial to the parties and can be used as a solution Avoiding a case brought to court which ultimately results in a decision that is certain to benefit one party, and causes the other party who feels disadvantaged to carry out the decision with a heavy heart, even though their land borders with each other.
