Abstract

Undang-Undang Nomor 5 Tahun 1960 tentang Peraturan Dasar Pokok-Pokok Agraria (“UUPA”) mengatur di antaranya Hak Milik tidak dapat dimiliki oleh orang asing. Orang asing hanya dapat memiliki hak atas tanah berupa Hak Pakai, tetapi Peraturan Menteri Agraria dan Tata Ruang/Kepala Badan Pertanahan Republik Indonesia Nomor 29 Tahun 2016 tentang Tata Cara Pemberian, Pelepasan, atau Pengalihan Hak Atas Pemilikan Rumah Tempat Tinggal atau Hunian oleh Orang Asing yang Berkedudukan di Indonesia (“Permen ATR 29/2016”) mengatur bahwa orang asing di antaranya dapat memiliki rumah tunggal di atas tanah Hak Pakai yang berasal dari perubahan Hak Milik karena jual beli. Selanjutnya tanah Hak Milik tersebut langsung jatuh menjadi tanah negara dan diberikan dengan perubahan menjadi Hak Pakai kepada orang asing yang bersangkutan. Akibatnya seolah-olah objek jual beli antara WNI dan orang asing dapat berupa tanah Hak Milik meskipun nantinya langsung diubah menjadi Hak Pakai, namun jika merujuk pada ketentuan UUPA, transaksi tersebut seketika batal demi hukum. Selain itu, Permen ATR 29/2016 ini terbit dalam rangka pelaksanaan Pemerintah Republik Indonesia Nomor 103 Tahun 2015 tentang Pemilikan Rumah Tempat Tinggal atau Hunian oleh Orang Asing yang Berkedudukan di Indonesia (“PP 103/2015”), namun dalam PP 103/2015 tidak tercantum ketentuan yang terdapat dalam Permen ATR 29/2016 sebagaimana tersebut di atas. Oleh karena itu rumusan masalah dalam penelitian ini adalah bagaimana kesesuaian antara Permen ATR 29/2016 dengan UUPA dan PP 103/2015 serta bagaimana pelaksanaan jual beli tanah berstatus Hak Milik kepada orang asing dikaitkan dengan Permen ATR 29/2016. Tujuan penelitian ini untuk mengetahui kesesuaian antara Permen ATR 29/2016 dengan UUPA dan PP 103/2015 terkait permasalahan tersebut dan untuk mengetahui pelaksanaan jual beli tanah berstatus Hak Milik kepada orang asing dikaitkan dengan Permen ATR 29/2016. Jenis penelitian yang digunakan oleh Penulis adalah penelitian hukum normatif dan bersumber dari data sekunder. Hasil penelitian atas permasalahan tersebut adalah adanya ketidaksesuaian antara Permen ATR 29/2016 dengan UUPA dan PP 103/2015 serta dalam praktiknya ketentuan Permen ATR 29/2016 sebagaimana disebutkan di atas belum dilaksanakan. / Act Number 5 of 1960 concerning Basic Regulations on Agrarian Principles (“UUPA”) regulates including but not limited to Freehold cannot be owned by foreigners. Foreigners can only have residential house on the land in the form of Right to Use, but the Minister of Agrarian and Spatial Planning Affairs/Head of the National Land Agency of the Republic of Indonesia Regulation Number 29 of 2016 concerning Procedures for Granting, Relinquishment, or Assignment of Ownership Rights over Residential Houses or Housing by Foreigners Resident in Indonesia (“Permen ATR 29/2016”) regulates that foreigners can own a residential house on land of Right to Use originating from changes of Freehold due to the sale and purchase of land, which further the land of Freehold immediately to be state land and granted to the foreigners after it changes to be Right to Use. The consequence is it seems the object of the sell and purchase transaction of the land between Indonesian citizens and foreigners can be in the form of Freehold, even though it will be immediately changed to be Right of Use, but if it refers to the provisions of the UUPA, the transaction is immediately null and void. Furthermore, this Permen ATR 29/2016 was issued in the context of the implementation of the Government of the Republic of Indonesia Regulation Number 103 of 2015 concerning Ownership of Residential Houses or Housing by Foreign Citizens Resident in Indonesia (“PP 103/2015”), but PP 103/2015 was not stated the provisions which contained in the Permen ATR 29/2016 as stated above. Therefore, the issues in this research regarding how is the compatibility between Permen ATR 29/2016 with UUPA and PP 103/2015 and how the implementation of sale and purchase of the Freehold land to foreigners related to Permen ATR 29/2016. The purposes of this research are to find out the compatibility of Permen ATR 29/2016 with UUPA and PP 103/2015 related to the issues as stated above and to find out the implementation of sale and purchase of the Freehold land to foreigners related to Permen ATR 29/2016. The type of research used by Author is normative legal research sourced from secondary data. The results of research on these problems are there are discrepancies between Permen ATR 29/2016 with UUPA and PP 103/2015 and in practice the provisions of Permen ATR 29/2016 as stated above have not been implemented.
