Abstract

Dalam era revolusi industri 4.0 penuh dengan dunia digital, komputerisasi, dan teknologi artificial intelligence (AI) memiliki dampak positif dan juga negatif yang harus diantisipasi. Dampak revolusi industri 4.0 memiliki efek yang besar di berbagai bidang dan sektor, termasuk sektor penegakan hukum terutama eksistensi (survive) profesi advokat dalam pemberian jasa hukum kepada kliennya. Perkembangan teknologi mesinmesin cerdas buatan manusia ini diyakini tidak berhenti dan terus berkembang menuju kesempurnaan. Dalam pengertian robotik ini akan semakin mampu menghasilkan karyakarya layanan jasa hukum yang bersifat analitis, taktis, dan situasional dengan hasil yang lebih akurat, lebih cepat, lebih murah ketimbang menggunakan jasa profesi advokat. Belum lagi, persaingan di kalangan para advokat tentu akan semakin ketat dan meningkat seiring pesatnya perkembangan teknologi. Tesis ini bertujuan untuk menganalisis (a) ketentuan hukum yang mengatur keberadaan Pop Legal sebagai Legal tech di Indonesia dan (b) dampak positif dan negatif keberadaan legal tech secara langsung terhadap industri jasa hukum yang dalam penelitian ini terbatas pada kepentingan utamanya, yaitu advokat. Tesis ini bersifat yuridis-empiris karena menggunakan kombinasi studi pustaka dan penelitian lapangan guna mampu menyajikan analisis hasil yang akurat sesuai dengan rumusan masalah. Hasil penelitian pada tesis ini menggambarkan kondisi bahwa ketentuan hukum yang mengatur keberadaan legal-tech startup tidak dibuat dalam satu perundangundangan yang khusus atau terfragmentasi pada berbagai undang – undang dan peraturan dibawahnya serta kode etik profesi yang terkait. / In the era of the industrial revolution 4.0 is full of the digital world, computerization, and artificial intelligence (AI) technology has positive and negative impacts that must be anticipated. The impact of the industrial revolution 4.0 has a large effect in various fields and sectors, including the law enforcement sector, especially the existence (survival) of the advocate profession in providing legal services to its clients. The development of technology of intelligent machines made by humans is believed to not stop and continue to develop towards perfection. In this robotic sense, it will be increasingly able to produce analytical, tactical, and situational legal services with results that are more accurate, faster, cheaper than using the services of a professional advocate. Besides that, competition among advocates will certainly be tighter and increase with the rapid development of technology. This thesis aims to analyze (a) the legal provisions governing the existence of Pop Legal as Legal tech in Indonesia and (b) the positive and negative impacts of the existence of legal technology directly on the legal service industry which in this study is limited to its main interests, for advocates. This thesis is juridical empirical because it uses a combination of literature studies and field research in order to be able to present an accurate analysis of results in accordance with the formulation of the problem. The results of this thesis illustrate the conditions that the legal provisions governing the existence of legal-tech startups are not made in one specific legislation or are fragmented in various laws and regulations below as well as related professional code of ethics.
