Abstract

Counterfeit medicine has a serious impact to the health of those who consumed it and may also be a threat to the community health of a nation. Under the state constitution Undang-Undang Dasar 1945, it is stipulated that health is one of the human rights aspects that should be protected by the state and therefore should be respected in all levels of state actors - executive, judicative and legislative. The state has rigorously put efforts to combat counterfeit medicine, yet it has not reduce the number of counterfeiters in the field. This dissertation examines the issues from three questions to be resolved: (1) how is the legal protection towards the trademark holder encountering the threat from counterfeit medicine?; (2) how effective is the law enforcement in Indonesia in tackling the circulation of counterfeit medicine?; (3) what would be the ideal norms to encounter the crime of counterfeit medicine? This study uses socio-legal research methods with various approaches: statutory, cases, and conceptual. The conclusion of this study reveals that from conceptual aspects of norms in the criminal sanctions stipulated in the prevailing laws and regulations does not put into account the element of serious impact of this counterfeit medicine to the health of an individual and or public health. The effectiveness of law enforcement would not be enough in having only a sound regulation, but also the support needed from of the supporting infrastructure including the level of understanding law enforcers, law makers, government, court institutions, industry and relevant professions on the serious impact of counterfeit medicine to health. The society culture in addressing the issues of such crime and its serious impact of counterfeit medicine to health need to be put as a concern. Therefore, since health is one of the human rights and acknowledged in the state constitution, therefore the crime of counterfeit medicine should be counted as a form of crime against humanity. / Pemalsuan obat mempunyai dampak serius bagi kesehatan individu yang mengonsumsinya. Selain itu, pemalsuan obat juga dapat menjadi ancaman kesehatan masyarakat suatu negara. Di dalam konstitusi UUD 1945, telah dinyatakan bahwa kesehatan merupakan salah satu hak asasi manusia yang harus dilindungi oleh negara. Untuk itu harus dihormati oleh setiap elemen kenegaraan baik eksekutif, yudikatif dan juga legislatif. Negara telah melakukan berbagai usaha untuk memberantas pemalsuan obat. Namun, usaha tersebut belum dapat menurunkan tingkat pemalsuan obat di lapangan. Disertasi ini membedah permasalahan tersebut dengan mencoba menjawab tiga pertanyaan: (1) bagaimanakah perlindungan hukum bagi pemegang merek dalam menghadapi ancaman pemalsuan obat?; (2) bagaimana efektivitas penegakan hukum di Indonesia dalam menghadapi peredaran obat palsu?; dan (3) bagaimanakah pengaturan yang ideal dalam mengatasi kejahatan pemalsuan obat? Disertasi ini menggunakan metode sosiolegal dengan beberapa pendekatan yaitu: perundang-undangan, kasus, dan konsep. Kesimpulan dari disertasi ini menemukan bahwa—secara aspek penormaan—di dalam sanksi pidana yang diatur dalam peraturan, tidak memasukan dampak serius dari obat palsu bagi kesehatan orang yang mengonsumsinya. Lalu, efektivitas dari suatu penegakan hukum tidak hanya berasal dari substansi pengaturan dalam regulasi. Namun, hal ini juga membutuhkan dukungan dari infrastruktur terkait—termasuk pemahaman para penegak hukum, pembuat peraturan, pemerintah, lembaga peradilan, industri serta profesi pendukung terkait ancaman kejahatan pemalsuan obat pada kesehatan. Budaya masyarakat dalam menanggapi kejahatan pemalsuan obat dan dampak serius dari obat palsu bagi kesehatan juga perlu diperhatikan. Oleh sebab kesehatan merupakan salah satu hak asasi manusia dan diakui di dalam konstitusi negara, maka kejahatan pemalsuan obat harus dianggap sebagai bentuk kejahatan terhadap kemanusiaan.
