Abstract

The presence of PT. Freeport in Indonesia for 45 years has brought a lot of impact for Indonesia, especially in Papua. But the operation of mining company caused a lot of controvercy about the mining contract of work that becomes the international agreement between the governments of and PT. Freeport Indonesia. This condition makes the government is in a difficult position, because of the relationship between Indonesia and the United States in the field of mining, which cause the interdependence between the two countries. This condition is risky for Indonesia as the United States has greater bargaining power and can be used to weaken the Indonesian government policy The purpose of this study is to analyze the contract of work, how PT. Freeport implements it, and its impact on the environment around the mining area. The data in this study were obtained through literature review, content analysis, and interviews with representatives of the Investment Coordinating Board. Analyses are performed by the method of narrative and illustrative. Through the data and the analysis. The author found that in the implementation of the PT. Freeport contract of work, the government prioritize the needs of the mining company, and the contract of work is not in accordance with the Mining Law year 2009. This condition is considered weak by the lack of legal certainty and the impact experienced by the local people around the mining area.
