Abstract

One of banking service to give credit to their customers. Credit given by bank has risk, so that is implementation within the bank should pay attention to the principles of prudent credit. One of the binding guarantee that the fiduciary. At the time the debtor non fullfillment of a liability that has been agreed, then they will be a proof that the debtor defaults. Fiduciary guarantee regulated in Indonesian Law Number 42 of 1999 about Fidusia Guarantee. However in the case, there is credit problem, not many people recognizes how to execute the guarantee especially for implementation in pawn-shop that fiduciary system is relatively new applied. With knowing the fiduciary system, such as what type the model used in implementation for fiduciary guarantee execution, public will know the matter related to fiduciary system, what rights and consequences when taking credit with fiduciary system.
