Abstract

This thesis explains the types of means of evidence being used by KPPU in proving business competition cases. Means of evidence is used to show the existence of violation by business actors, including cartel. KPPU has started implementing indirect evidence in several cases. As a real example, the Author use case No. 08/KPPU-I/2014 regarding cartel operated by 6 tire manufacturers under Indonesian Tire Manufacturer Association (APBI). In this case, we can see the implementation of indirect evidence which consist of communication evidence and economic evidence being used by the investigator to prove the violation of six tire manufacturers of Article 5(1) and Article 11 of Law No. 5 Year 1999 regarding Prohibition of Monopolistic Practices and Unfair Business Competition / Skripsi ini menjelaskan tentang alat bukti yang digunakan oleh KPPU dalam membuktikan kasus persaingan usaha. Alat bukti digunakan untuk menunjukkan bahwa memang terjadi pelanggaran diantara pelaku usaha, salah satunya adalah kartel. KPPU saudah mulai menggunakan bukti tidak langsung pada beberapa kasus. Untuk mendapatkan contoh riil, Penulis menggunakan kasus No. 08/KPPU-I/2014 tentang dugaan pelanggaran kartel dalam industri ban terhadap 6 produsen ban yang menjadi anggota Asosiasi Pengusaha Ban Indonesia. Dalam kasus ini bisa dilihat penerapan atau penggunaan alat bukti tidak langsung yang terdiri dari alat bukti komunikasi dan alat bukti ekonomi yang digunakan oleh investigator dalam membuktikan keenam pelaku usaha benar-benar melanggar Pasal 5(1) dan Pasal 11 Undang-Undang No. 5 Tahun 1999 tentang Larangan Praktek Monopoli dan Persaingan Usaha Tidak Sehat.
