Abstract

Financial Services Authority as an institution that regulates and oversees the activities of the insurance serves to create a financial system growing sustainably, stable and brings forth public trust in the insurance industry. Within the scope of regulation and supervision in the insurance sector, Financial Services Authority has the authority in the request statement of bankruptcy of the company insurance, in this case PT. Syariah Mubarakah Insurance to protect the interests of insurance policy holders. The discussion of this thesis aims to know the authority of the Financial Services Authority in oversees the activities of PT. Syariah Mubarakah Insurance and bankruptcy filing procedure to PT. Syariah Mubarakah Insurance as an institution for collecting public funds. Research method in this thesis is normative law research with analytical descriptive writing specification, and by data collection method of literature study. Based on the result of research, the authority from Financial Service Authority to file bankrupt petition of the Insurance Companies or in this case PT. Syariah Mubarakah Insurance are regulated in Law No. 21/2011 Financial Service Authority and Law No. 40/2014 Insurance. The procedure of filing a petition for bankruptcy can be done against PT. Syariah Mubarakah Insurance, after there is a request from creditors to the Financial Services Authority, then the Financial Services Authority checks over the petition. If the Financial Services Authority approves it then submits the request for bankruptcy to the Commercial Court, and if the Financial Services Authority declines, the denial must be made in writing with the reasons.
