Abstract

Sebagai seorang pejabat umum, notaris memiliki peraturan yang mengatur profesinya diantaranya adalah Undang-Undang Jabatan Notaris serta Kode Etik Notaris, yang mana peraturan tersebut perlu dipatuhi di dalam menjalankan tugas jabatannya. Notaris merupakan profesi yang sangat mulia, ia juga mempunyai tanggung jawab yang besar karena akta yang ia buat mempunyai kekuatan pembuktian yang sempurna. Akan tetapi, bagaimana bila notaris melanggar peraturan yang mengatur mengenai profesinya? Penelitian ini ingin mengetahui tentang tanggung jawab seorang Notaris terhadap pelanggaran Undang-Undang Jabatan Notaris yang dilakukan, serta peran dari Majelis Pengawas Wilayah Notaris dalam menindak Notaris yang bersangkutan. Berdasarkan kasus yang penulis ambil, Notaris melakukan kesalahan di dalam menjalankan tugas jabatannya sebagai Notaris (melanggar Undang-Undang Jabatan Notaris serta Kode Etik Notaris), oleh sebab itu ia berkewajiban untuk menanggung sanksinya. Sanksi yang diberikan bermacam-macam, yakni dari sanksi berupa teguran sampai dengan pemberhentian tidak hormat. Peran Majelis Pengawas Wilayah Notaris terlihat di dalam kasus ini, yakni dengan memeriksa terlebih dahulu laporan-laporan yang masuk dari masyarakat, kemudian Majelis Pengawas Wilayah Notaris mengumpulkan fakta-fakta yang ada untuk memastikan kebenaran dari laporan yang disampaikan, kemudian ia menganjurkan sanksi yang sesuai dengan pelanggaran yang dilakukan oleh Notaris. Sanksi yang diberikan beragam, biasanya disesuaikan dengan kuantitas dan kualitas dari pelanggaran yang dilakukan oleh Notaris. / As a general official, Notary has a regulation that organize their profession, such as Law of Notary Title and the Ethical Code of Public Notary, which means that the regulation should be obeyed to fulfil their duty. Notary is a noble profession, and also have a great responsible, because every deed that they make has a power to be an authentic deed, which means as of can be a perfect evidence. However, what if a Notary do not comply which govern about their profession? The aim of this research is to know about Notary’s responsibility towards violation against Law of Notary title which was conducted, along with the role of Regional Notary Supervisory Board in that matter. Based on the case presented in this thesis, Notary had faulted in performing the duty as a Notary (violated the Law of Notary Title and the Ethical Code of Public Notary), that being said, she must face consequences. Consequences given are varied from reprimand to the point of discharged dishonorably. The role of Regional Notary Supervisory Board seen in this case, which was inspected reports from the public then proceed to collecting facts to ensure the validity of the report given. Subsequently, the Regional Notary Supervisory Board suggest punishment in accordance to violations committed by Notary. Punishments given are diverse, it depends on the quantity and quality of the violations that had been done.
