Abstract

Jual beli dalam Kitab Undang-Undang Hukum Perdata Pasal 1457 adalah suatu perjanjian dengan mana pihak yang mengikatkan dirinya untuk menyerahkan suatu kebendaan, dan pihak yang lain untuk membayar harga yang telah dijanjikan. Jual beli hak atas tanah dalam Peraturan Pemerintah Nomor 24 Tahun 1997 tentang Pendaftaran Tanah harus dilaksanakan dihadapan Pejabat Pembuat Akta Tanah agar dapat mendaftarkan peralihan hak atas tanahnya ke Kantor Badan Pertanahan Nasional agar terciptanya kepastian hukum. Pada faktanya, masih ditemukannya jual beli yang dilakukan dibawah tangan. Jual beli yang dilakukan dibawah tangan dianggap sah apabila jual beli tersebut dilakukan sesuai dengan ketentuan yang tercantum dalam Kitab Undang-Undang Hukum Perdata Pasal 1320 tentang syarat sahnya perjanjian. Penelitian ini menggunakan metode penelitian normatif empiris. Hasil penelitian ini ditemukan bahwa terhadap jual beli yang dilalukan dibawah tangan tetap sah namun tidak terjadinya balik nama. Begitu dengan jual beli dihadapan Pejabat Pembuat Akta Tanah yang mengandung identitas palsu dalam kasus ini tidak dilakukannya pembuktian atas unsur identitas palsu dari para pihaknya sehingga jual beli tersebut tetap dianggap sah. / Buying and selling in the Indonesian Civil Law section 1457 is defined as an agreement by which the parties bound themselves to submit the material, and the other party to pay the price that has been promised. Buying and selling land is a legal act according to Goverment Regulation Number 27 Year 1997 shall be conducted a Land Deed Official (PPAT) to register the right of land rights to the Land Office to create legal certainty. In fact, is still frequently found in buying and selling in under hand. Buying and selling in under hand is still valid also for compliance with the provisions of the Civil Law section 1320 of the validity of the agreement terms. This research used normative and empirical research method. The result in this research, buying and selling in under hand is still valid but buying and selling in under hand can not to register the right of land rights to the Land Office. Buying and selling in front of Land Deed Official (PPAT) which contains the false identities in this case, there is no proofing of the element about false identities of the parties in buying and selling agreement so that buying and selling are still valid.
