Abstract
Peraturan Pemerintah Republik Indonesia Nomor 103 Tahun 2015 Tentang Pemilikan Rumah Tempat Tinggal Atau Hunian Oleh Orang Asing Yang Berkedudukan Di Indonesia dan Peraturan Menteri Agraria Nomor 29 Tahun 2016 Tentang Tata Cara Pemberian, Pelepasan Atau Pengalihan Hak Atas Pemilikan Rumah Tempat Tinggal Atau Hunian Oleh Orang Asing Yang Berkedudukan Di Indonesia guna meberikan kepastian hukum untuk memiliki Rumah Tempat Tinggal Atau Hunian Oleh Orang Asing sebagai pelaksana mengenai Hak Pakai yang hanya boleh dimiliki Orang Asing. Dalam penelitian ini, permasalahan yang diteliti yaitu mengapa Pemerintah menerbitkan Peraturan Pemerintah Nomor 103 Tahun 2015 tentang Pemilikan Rumah Tinggal Atau Hunian Oleh Orang Asing yang Berkedudukan Di Indonesia dan Peraturan Menteri Agraria Nomor 29 Tahun 2016 tentang Tata Cara Pemberian, Pelepasan atau Pengalihan Hak Atas Pemilikan Rumah Tempat Tinggal atau Hunian Oleh Orang Asing yang Berkedudukan di Indonesia dan bagaimana penyelesaian sengketa jual beli tanah dengan perjanjian nominee dikaitkan dengan kasus yang sudah berkekuatan hukum tetap. Tujuan penelitian yaitu untuk menganalisis apa yang menjadi sumber permasalahan dengan mengkaitkan aturan hukum yang berlaku di Indonesia, Dari hasil penelitian mengenai perjanjian nominee belum diatur sehingga batal dan seharusnya objek sengketa perjanjian nominee disita negara , dapat disimpulkan perlunya sosialisasi mengenai aturan hukum terhadap orang asing sehingga tidak adanya penyeludupan hukum dengan nominee, perlunya penegakan adil sehingga negara Indonesia di pandang positif oleh negara asing. / Indonesian Government Regulation Number 103 Year 2015 On Ownership Of Dwelling Of Residency House By Foreign Persons Domiciled In Indonesia And Minister Of Agrarian And Spatial Planning Affairs / Head Of The National Land Agency Regulation No. 29 Of 2016 On Procedures For The Granting, Relinquishment And Assignment Of Ownership Rights Over Residential Homes Or Housing By Foreigners Resident In Indonesia in order to provide legal certainty to have a Foreign Residential or Residential House as the executor of the Right to Use that only Foreigners may have. In this research , the problem examined is why the Government issued Indonesian Government Regulation Number 103 Year 2015 On Ownership Of Dwelling Of Residency House By Foreign Persons Domiciled In Indonesia And Minister Of Agrarian And Spatial Planning Affairs / Head Of The National Land Agency Regulation No. 29 Of 2016 On Procedures For The Granting, Relinquishment And Assignment Of Ownership Rights Over Residential Homes Or Housing By Foreigners Resident In Indonesia and how the settlement of land purchase disputes with a nominee agreement is related to cases that have permanent legal force. The research objective is to analyze what is the source of the problem by linking the applicable legal rules in Indonesia. From the results of research on nominee agreements that have not been regulated so that the object of the nominee agreement disputes should be confiscated by the state, it can be concluded the need for socialization regarding the rule of law against foreigners so the existence of law smuggling with nominees, the need for fair enforcement so that the Indonesian state is viewed positively by foreign countries
