Abstract

The inheritance law is closely related to the scope of human life, for every person would surely get into legal event which referred to as mortality. Legal consequences which will be arising with the occurence of mortality of a person is, such as a matter regarding the arrangement and continuation of such the late person's rights and obligations. Moreover, it involves a heir whom status as a child from out of marriage. The inheritance of such kid has to in accordance with the laws for the creation of justice. A judge's decision becomes a point in which a person could defend his/her rights in obtaining the heritage, mainly the child from out of marriage who does not obtain the heritage and intends to get his/her portion as a legitimate child from out of marriage. It is important in a judge's decision to decide in accordance with the applicable principles, i.e. justice, expediency, and legal certainty.
