Abstract

Itikad baik merupakan salah satu syarat untuk melakukan perjanjian. Itikad baik adalah suatu tindakan yang tidak berwujud tetapi dapat diketahui pada saat melakukan suatu perjanjian. Itikad baik dalam Perjanjian Pengikatan Jual Beli Tanah harus tercermin dari pihak penjual maupun pembeli hak atas tanah. Notaris sebagai pejabat umum yang berwenang untuk membuat Perjanjian Pengikatan Jual Beli harus melakukan penelitian terhadap objek hak atas tanah yang akan diperjualbelikan. Penelitian yang dimaksud adalah mengetahui status tanah objek jual beli merupakan milik dari penjual, melakukan pengecekan harga yang layak, objek yang diperjualbelikan tidak dalam sitaan, tidak dalam status jaminan dan telah memperoleh keterangan dari Badan Pertanahan Nasional (BPN) mengenai riwayat dari objek yang diperjualbelikan. Berdasarkan Putusan Mahkamah Agung Nomor 2018K/PDT/2014 objek yang diperjualbelikan terindikasi masuk ke dalam boedel pailit sehingga akta Perjanjian Pengikatan Jual Beli harus batal demi hukum. Boedel pailit adalah penyitaan seluruh harta kekayaan milik debitur berdasarkan putusan pailit pengadilan niaga yang akan diberikan kepada kreditur. Dengan demikian batalnya Perjanjian Pengikatan Jual Beli menyebabkan kerugian bagi para pihak. Penelitian terhadap itikad baik penjual dan pembeli sangat penting untuk mengurangi kemungkinan batalnya suatu perjanjian. Dengan batalnya perjanjian pihak yang dirugikan dapat menuntut penggantian biaya, ganti rugi dan bunga kepada notaris. / Good faith is one of the conditions for making an agreement. Good faith is an action that is intangible but can be known when making an agreement. Good faith in the Land Sale and Purchase Agreement must be reflected in both the seller and the buyer of the land rights. Notary as a public official who has the authority to make a Sale and Purchase Agreement must conduct an examination of the object of the land rights to be traded. The research referred to is knowing the status of the land of the object of sale and purchase belongs to the seller, checking the proper price, the object being traded is not in confiscation, is not under guarantee status and has obtained information from the National Land Agency (BPN) regarding the history of the object being traded. Based on the Decision of the Supreme Court Number 2018K / PDT / 2014, the object being traded is indicated to be included in the bankruptcy bill so that the Sale and Purchase Agreement deed must be null and void by law. Bankruptcy Boedel is the confiscation of all assets belonging to the debtor based on the bankruptcy decision of the commercial court which will be given to the creditor. Thus the cancellation of the Sale and Purchase Agreement causes losses for the parties. Research on the good faith of sellers and buyers is very important to reduce the possibility of an agreement being canceled. With the cancellation of the agreement, the injured party can claim reimbursement of expenses, compensation and interest from the notary public.
