Abstract

Tujuan Penelitian skripsi “Akibat Hukum Sertifikat Ganda Dalam Hukum Pertanahan Indonesia (Tinjauan Yuridis Putusan Mahkamah Agung RI Nomor:38/K/TUN/2014) ialah pertama untuk mengetahui akibat hukum dari sertifikat ganda hak atas tanah dilihat dari Hukum Pertanahan Indonesia, dan kedua untuk mengetahui tanggung jawab Badan Pertanahan Nasional (BPN) sebagai pejabat negara yang berwenang dalam menerbitkan sertifikat terutama mengenai sertifikat ganda. Metode penelitian yang digunakan dalam penelitian ini adalah Metode penelitian Normatif, sumber data yang digunakan yaitu bahan hukum primer, sekunder dan tersier dari undang-undang dengan melakukan penelitian kepustakaan (library research) mengenai Hukum Pertanahan dan wawancara dengan Badan Pertanahan Kota Medan, dan Teknik analisis data yang digunakan ialah kualitatif bersifat deskriptif yang memfokuskan pada asas hukum dan proses serta pendapat subjek penelitian. Hasil Penelitian yang diperoleh penulis ialah pertama, akibat hukum dari sertifikat ganda (overlapping) pihak-pihak terkait menanggung kerugian dan tidak bisa mengusahakan ataupun mengalihkan tanah miliknya, kedua tanggung jawab yang diberikan oleh pihak Badan Pertanahan Nasional adalah membatalkan sertifikat yang terbukti tumpang tindih (overlapping) dan pemalsuan dokumen sertifikat taah dapat dipidana sesuai peraturan yang berlaku, sehingga dapat memberikan kepastian hukum kepada pemegang sertifikat sesuai dengan tujuan pendaftaran tanah dan asas hukum pertanahan dalam Undang-Undang Pokok Agraria (UUPA)./Thesis Research Objectives "The Legal Impact of Double Certificates in Indonesian Land Law (Judicial Review of the Supreme Court's Decision RI Number: 38 / K / TUN / 2014) is first to find out the legal consequences of the dual certificate of land rights seen from the Indonesian Land Law, and secondly to know the responsibility of the National Land Agency (BPN) as a state official in charge of issuing certificates, especially regarding dual certificates. The research method used in this study is the Normative research method, the data sources used are primary, secondary and tertiary legal materials from the law by conducting library research on Land Law and interviews with the Medan City Land Agency, and analysis techniques. The data used is descriptive qualitative which focuses on the principles of law and the process and opinions of research subjects. The research results obtained by the author are firstly, due to the legal consequences of the overlapping certificates, the parties bear the loss and are unable to cultivate or transfer their land, secondly, the responsibility given by the National Land Agency is to cancel the certificate which is proven to overlap ) so as to provide legal certainty to the certificate holder in accordance with the purpose of land registration and the principle of land law in the Basic Agrarian Law.
