Abstract

Hak atas Merek merupakan hak eksklusif yang diberikan oleh Negara kepada pemilik Merek yang terdaftar dalam Daftar Umum Merek untuk jangka waktu tertentu dengan menggunakan sendiri Merek tersebut atau memberikan izin kepada pihak lain untuk menggunakannya, berdasarkan Undang-Undang Merek dan Indikasi Geografis Nomor 20 Tahun 2016, Pasal 41 ayat (1) mengatur mengenai pengalihan hak atas merek , dalam hal ini merek dapat beralih apabila sudah dicatatkan dan diumumkan dalam berita resmi merek. Lebih lanjut akan dijelaskan pengaturan mengenai pengalihan hak atas merek menurut hukum positif di Indonesia, serta bagaimana pelaksanaan mengenai perkara pengalihan hak atas merek , untuk menjawab rumusan masalah tersebut penulis melakukan penelitian dengan menggunakan metode yuridis normatif, dan wawancara dengan tujuan untuk mengetahui pengalihan hak atas merek khususnya melalui akta jual beli yang dibuat melalui Notaris. Maka dalam hal ini pelaksanaan teknis yang terjadi di lapangan terkait dengan pengalihan hak atas merek kelas 43 yaitu antara Asep Solihin sebagai penjual merek Soerabi Enhaii kepada Andri Anis dan Yasmar sebagai pembeli merek Soerabi Enhaii yang digugat oleh Cecep Sumarno selaku pemilik merek terdaftar kelas 30 Soerabi Enhaii. Dalam hal ini akan dikaji lebih lanjut mengenai proses pengalihan hak atas merek antara para pihak tersebut dan sah tidaknya jual beli yang telah dilakukan para pihak dihadapan Notaris serta bagaimana putusan pengadilan dalam perkara Soerabi Enhaii. / The right to a mark is an exclusive right granted by the State to the owner of the mark that is registered in the General Register of Marks for a certain period of time by using the mark himself or giving permission to other parties to use it, based on the Trademark Law and Geographical Indication Number 20 of 2016, Article 41 paragraph (1) regulates the transfer of rights to a mark, in which case the mark can switch if it has been recorded and announced in the official news of the mark. Further regulations will be explained regarding the transfer of rights to trademarks according to positive law in Indonesia, as well as how the implementation of the case of transfer of rights to trademarks, to answer the formulation of the problem the authors conducted research using normative juridical methods, and interviews with the aim to find out the transfer of rights to trademarks especially through the sale and purchase deed made through a Notary. So in this case the technical implementation that took place in the field was related to the transfer of rights to the class 43 mark, namely between Asep Solihin as the seller of the Soerabi Enhaii brand to Andri Anis and Yasmar as the buyer of the Soerabi Enhaii brand which was sued by Cecep Sumarno as the owner of the registered brand 30 class Soerabi Enhaii . In this case, it will be examined further about the process of transferring the rights to the trademark between the parties and the legitimacy of the sale and purchase made by the parties before a Notary and how the court's decision in the case of Soerabi Enhaii.
