Abstract

Dokter di dalam menjalankan profesinya diikat oleh sebuah kode etik dokter, di Indonesia sendiri kode etik dokter di atur di dalam KODEKI (kode etik kedokteran Indonesia) sebagai, standar profesi dokter di dalam menjalankan profesinya sehingga melindungi doker maupun masyarakat dalam hal ini pasien dari hal-hal yang nantinya mungkin saja merugikan salah satu atau kedua belah pihak. Selain kode etik kedokteran hubungan dokter dan pasien juga di dasarkan pada perjanjian teraupetik sebagai dasar hubungan antara dokter dan pasien dalam konteks keperdataan. Kode etik kedokteran maupun perjanjian teraupetik keduaanya merupakan sarana perlindungan hukum pasien atas tindakan yang dilakukan dokter. Dengan adanya perlindungan hukum tersebut maka pasien dapat meminta tangung jawab dokter terhadap kesahalaan yang merugikan pasien bukan hanya dari segi etik namun juga dari segi keperdataan dalam benuk ganti rugi. Permasalahan yang timbul terkait perlindungan hukum terhadap bentuk tanggung jawab dokter di bidang keperdataan adalah terkait hubungan hukum antara dokter dan pasien serta perlindungan hukum terhadap pasien itu sendiri baik dari segi kode etik maupun keperdataan sehingga menarik untuk di teliti tentang Perlindungan Hukum Terhadap Bentuk Tanggung Jawab Profesi Kedokteran Di Bidang Keperdataaan dengan jenis penelitian normatif yaitu dengan menggunakan studi kepustakaan terkait dengan hukum kesehatan dan etika profesi kedokteran untuk mengetahui tentang Perlindungan Hukum Terhadap Bentuk Tanggung Jawab Profesi Kedokteran Di Bidang Keperdataaan. Kesimpulan dari penelitian ini antara lain Hubungan Dokter dan Pasien di dalam pemberian layanaan Kesehatan di dasarkan pada perjanjian terapeutik sehingga dokter ataupun pasien memiliki hak dan kewajiban yang bersifat keperdataan. Saran dari Penelitian ini antara lain Agar menjamin perlindungan hukum pasien di dalam hubungan dokter dan pasien di dalam pemberian layanan kesehatan yang di dasarkan pada perjanjian terapeutik/ Doctors in carrying out their profession are bound by a doctor's code of ethics, in Indonesia the doctor's code of ethics is set in the KODEKI (Indonesian medical code of ethics) as a standard for the doctor's profession in carrying out his profession so as to protect both the doctor and the public in this case the patient from things that might later be detrimental to one or both parties. In addition to the medical code of ethics, the relationship between doctor and patient is also based on the therapeutic agreement as the basis of the relationship between doctor and patient in the civilian context. Both the medical code of ethics and the therapeutic agreement are a means of legal protection for patients for actions taken by doctors. With this legal protection, the patient can ask the doctor's responsibility for the fact that harms the patient not only in terms of ethics but also in terms of civilization in the form of compensation. Problems that arise related to legal protection of the forms of physician responsibility in the civil field are related to the legal relationship between doctors and patients as well as legal protection to patients themselves both in terms of code of ethics and civilization so it is interesting to study about Legal Protection Against Forms of Professional Responsibility for Medical In the Field of Civil Servants with the type of normative research that is by using literature studies related to health law and medical professional ethics to find out about Legal Protection of the Forms of Medical Professional Responsibility in the Field of Civil Servants. The conclusions of this study include the relationship between doctors and patients in the provision of health services based on therapeutic agreements so that doctors or patients have civil rights and obligations. Suggestions from this research, among others, are to ensure the legal protection of patients in the relationship between doctors and patients in the provision of health services based on therapeutic agreements.
