Abstract

Penelitian ini bertujuan untuk mengetahui pertanggungjawaban pidana terhadap pelaku yang melakukan transaksi seks melalui transaksi elektronik dan mengetahui pertimbangan hukum oleh seorang hakim dalam hal memutus perkara terhadap pelaku tindak pidana yang melakukan transaksi seks melalui transaksi elektronik. Penelitian ini menggunakan penelitian hukum normatif yang digunakan untuk mengkaji peraturan perundang-undangan guna keperluan untuk menyusun karya akademis dalam hal pertanggungjawaban pidana terhadap pelaku yang melakukan transaksi seks melalui transaksi elektronik dan serta pertimbangan hukum oleh hakim dalam memutus perkara terhadap pelaku tindak pidana tersebut. Hasil penelitian ini menunjukkan bahwa Pertanggungjawaban pidana terhadap pelaku yang melakukan transaksi seks melalui transaksi elektronik adalah pertanggungjawaban berupa sanksi pidana yang dikenakan terhadap mucikari sebagaimana telah dicantumkan dalam ketentuan Undang-Undang tentang Informasi dan Transaksi Elektronik dan Undang-Undang Pornografi serta Kitab Undang-Undang Hukum Pidana, namun dalam ketentuan Kitab Undang-Undang Hukum Pidana tidak ada pasal yang dapat digunakan untuk menjerat pengguna jasa pekerja seks komersial. / This research aims to determine criminal liability against perpetrators of sex transactions through electronic transactions and to be aware of legal considerations by a judge in the event of disconnecting the perpetrator of a criminal act in a sex transaction through electronic transactions. This research uses normative legal research that is used to examine statutory regulations for the need to compose academic work in the event of criminal liability against perpetrators who conduct sex transactions through electronic transactions and as well as legal considerations by judges in disconnecting the perpetrators of the criminal act. The results of this study show that criminal liability against perpetrators of sex transactions through electronic transactions is the accountability of criminal sanctions imposed on pimps as stipulated in the provisions of the Law on information and electronic transactions and the Pornography law and the Criminal Code law, but in the provisions of the Code of Law there is no article that can be used to ensnare users of commercial sex worker services.
