The 1945 Constitution of the Republic of Indonesia, particularly from the article 33, had authorized the nation to control production branches vital to the state and the needs of people in general. In order to accommodate the 1945 Constitution of the Republic of Indonesia article 33, the Law Number 5 of 1999 Concerning the Prohibition of Monopolistic Practices and Unfair Competition in the Article 51 regulate that entrepreneurs is permitted to centralize activities related to the production and/or marketing of goods and/or services which control the needs of people in general and production branches vital to the state. In this case, government is allowed to give exclusive controlling rights for state-owned entities to organize their business activities with the purpose of public benefits. This matter also regulated on the Law Number 19 of 2003 Concerning State-Owned Entities on the Article 66 Section (1). In terms of electricity supply in Indonesia, the state gave exclusive mastery rights to PT Perusahaan Listrik Negara (PLN). In practice, PT PLN has to operate its business activities based on the principle of kinship and prioritizing the welfare and prosperity of Indonesian citizens. The Law Number 30 of 1999 Concerning Electricity on the Article 4 Section (1) and Section (2) regulate that the conduct of power supply business by the Government and the regional governments shall be authorized to state-owned entities and region owned entities, whereas Private entities, cooperatives, and self-reliant communities may participate in power supply business.
