Abstract

Penelitian ini bertujuan untuk mengetahui bagaimana bentuk perlindungan hukum terhadap pemalsuan merek sepatu ditinjau dari Undang-Undang Merek dan Indikasi Geografis serta untuk mengetahui bagaimana akibat hukum yang timbul dari jual beli barang palsu di Indonesia. Pengumpulan data dilakukan dengan Metode Normatif Yuridis, yang menggunakan data sekunder seperti buku, peraturan perundang-undangan sebagai bahan utama dalam penelitian. Data yang digunakan dalam penelitian ini data primer dan sekunder. Pengumpulan data dilakukan melalui studi pustaka dan wawancara dengan berbagai narasumber baik melakukan wawancara dengan penjual barang palsu, Dirjen HAKI, dan Lawyer bidang Merek. Dalam melakukan penelitian, penulis melakukan pendekatan penelitian kualitatif dengan mencermati segala peraturan atau regulasi yang berhubungan dengan rumusan permasalahan. Data yang telah penulis dapatkan, kemudian dilakukan analisis deskriptif untuk mendapat jawaban terhadap rumusan masalah yang penulis hadapi. Dari hasil penelitian dapat diperoleh bahwa Perlindungan Hukum terhadap pemilik merek secara praktik, berdasarkan hasil penelitian dianggap telah sesuai dengan peraturan yang berlaku, baik dari sisi pencegahan maupun penindakan. Dirjen Kekayaan Intelektual sebagai pihak yang berwenang melakukan perlindungan hukum, dan Lawyer bidang Merek yang melakukan pendampingan hukum terhadap pemilik merek telah menjalankan tugasnya sesuai dengan apa yang menjadi tujuan dari Peraturan Perundang-undangan tentang Perlindungan merek. Pelanggaran terhadap hak merek akan menimbulkan akibat hukum berupa penjatuhan sanksi penjara atau denda jika dilakukan penuntutan secara pidana, sanksi ganti rugi dan putusan larangan penjualan merek palsu jika digugat secara perdata maupun melalui Penyelesaian Sengketa Alternatif. Penjatuhan sanksi dan hukuman tersebut tentunya akan menjadi akibat daripada pelanggaran hak merek terdaftar dan akan memberikan efek jera kepada pelaku pemalsuan merek terdaftar./This study aims to determine how the form of legal protection against counterfeiting shoe brands in terms of the Trademark Law and Geographical Indications and to find out how the legal consequences arising from buying and selling counterfeit goods in Indonesia Data collection is done by the Normative Juridical Method, which uses secondary data such as books, laws and regulations as the main material in research. The data used in this study are primary and secondary data. Data collection was carried out through literature studies and interviews with various sources, both conducting interviews with imitation goods sellers, the Director General of Intellectual Property Rights, and Brand Lawyer. In conducting research, the authors conducted a qualitative research approach by examining all the rules or regulations relating to the formulation of the problem. The data that obtained, then performed a descriptive analysis to get an answer to the formulation of the problem that the writer faces. From the results of the study it can be concluded that the Legal Protection of brand owners in practice, based on research results are considered to be in accordance with applicable regulations, both in terms of prevention and enforcement. The Director General of Intellectual Property as the authorized party to carry out legal protection, and Brand Lawyer in the conducting legal assistance to the trademark owner has carried out their duties in accordance with what is the purpose of the Laws and Regulations concerning brand protection. Violation of trademark rights will result in legal consequences in the form of imprisonment or fines if criminal prosecution is carried out, sanctions for compensation and a decision to ban the sale of counterfeit marks if sued civilly or through Alternative Dispute Resolution. The imposition of sanctions and penalties will certainly result from violations of registered trademark rights and will have a deterrent effect on the perpetrators of counterfeiting registered marks.
