Abstract

Indonesia Penelitian ini bertujuan untuk mengetahui akibat hukum yang timbul dari sengketa kredit-kredit bermasalah pada PT.Sinar Menara Deli dan juga penyelesaian yang dilakukan oleh Badan Penyelesaian Sengketa Konsumen (BPSK) Medan dan Pengadilan Negeri (PN) Medan. Penelitian ini menggunakan metode penelitian yang bersifat normatif yang berperilaku hukum dengan mengkaji Undang-Undang yang tertera dan berkaitan dengan bermasalah.Dalam penelitian ini diteliti oleh penulis secara langsung atau pendekatan langsung dari bahan hukum sekunder.Teknik pengumpulan data penelitian dilakukan melalui studi pustaka, baik dari buku maupun jurnal hukum yang berkaitan dengan permasalahan. Dalam penelitian tersebut, penulis telah mendapatkan data yang akan dianalisis secara deduktif kualitatif untuk mendapatkan jawaban atas permasalahan. Hasil penelitian menunjukkan bahwa, akibat hukum terhadap kredit macet antara PT. Sinar Menara Deli dengan Sari Alamsyah menyatakan bahwa Badan Penyelesaian Sengketa Konsumen (BPSK) memang tidak memiliki wewenang untuk memutuskan sengketa tersebut karena tidak adanya kesepakatan antara kedua belah pihak tersebut untuk menyelesaikan sengketanya di Badan Penyelesaian Sengketa Konsumen (BPSK), walaupun sebenarnya dalam Undang-Undang No. 8 Tahun 1999 tentang Perlindungan Konsumen sebenarnya berwenang menangani sengketa tersebut karena tidak ada batasan sengketa seperti apa saja yang BPSK selesaikan, apalagi dalam PPJB yang telah diperbuat dan disepakati kedua belah pihak mengenai perjanjian ini dengan segala akibat pelaksanaannya kedua belah pihak telah setuju memiliki kediaman tetap dan seumurnya di kantor Panitera Pengadilan Negeri Medan. Sehingga keputusan dari BPSK dinyatakan batal demi hukum dan tetap keputusan Pengadilan Negeri (PN) yang diakui sesuai dengan yang tertera di PPJB yang memutuskan mengabulkan permohonan pemohon keberatan selaku pelaku usaha dan membatalkan Putusan dari Badan Penyelesaian Sengketa Konsumen (BPSK). / English This study aims to determine the legal consequences arising from disputes on non-performing loans at PT. Sinar Menara Deli and also the settlement carried out by Medan Consumer Dispute Resolution Agency (BPSK) and Medan District Court (PN). This study uses a normative research method that behaves in a legal manner by reviewing the laws that are listed and relating to problems. In this study, the authors examined directly or the direct approach of secondary legal material. Research data collection techniques are carried out through literature studies, both from books and legal journals relating to the problem. In this study, the authors have obtained data that will be analyzed in a deductive qualitative way to get answers to problems. The results showed that, due to the legal effect on bad loans between PT. Sinar Menara Deli and Sari Alamsyah stated that the Consumer Dispute Settlement Agency (BPSK) does not have the authority to decide on the dispute because there is no agreement between the two parties to resolve the dispute at the Consumer Dispute Resolution Agency (BPSK), even though it is actually in the Act No. 8 of 1999 concerning Consumer Protection actually has the authority to handle such disputes because there are no boundary disputes such as what BPSK has resolved, especially in the PPJB that has been made and agreed by both parties regarding this agreement with all the consequences of its implementation both parties have agreed to have a permanent residence and his age at the Medan District Court Registrar's office. So that the decision of BPSK is declared null and void by law and remains the decision of the District Court (PN) which is recognized in accordance with those listed in the PPJB which decides to grant the petition for objection as a business actor and cancels the Decision of the Consumer Dispute Settlement Agency (BPSK).
