Abstract

Penyalahgunaan keadaan merupakan salah satu dasar yang dapat digunakan sebagai alasan untuk membatalkan sebuah perjanjian. Penyalahgunaan keadaan terjadi ketika terdapat pihak yang dengan sengaja menikmati keadaan orang lain. Hal ini terjadi bukan dengan membuat isi perjanjian batal, tetapi menyebabkan kehendak disalahgunakan sehingga menjadi tidak bebas. Unsur yang terkandung dalamnya memiliki persamaan dan perbedaan dengan cacat kehendak lain yang diatur di dalam Burgerlijk Wetboek (selanjutnya disebut BW). Tujuan dari penelitian ini adalah untuk mencari pembuktian adanya unsur penyalahgunaan yang terkandung dalam perjanjian utang piutang yang kemudian dimanfaatkan menjadi jual beli tanah. Kemudian dilihat apakah prosedur tersebut sudah sesuai dengan jual beli tanah yang ideal sesuai dengan undang-undang. Penelitian ini menggunakan pendekatan normatif, dimana data yang digunakan penulis adalah data sekunder yang terdiri dari bahan hukum primer, sekunder dan tersier. Hasil dari penelitian ini menjelaskan bahwa untuk membuktikan apakah suatu perbuatan dapat dikatakan mengandung unsur penyalahgunaan dengan membuktikan bahwa perbuatan tersebut mengandung unsur ketidakseimbangan posisi antar para pihak dan melihat apakah perbuatan tersebut membatasi kehendak bebas dari salah satu pihak. Selanjutnya, terkait dengan jual beli tanah yang sah adalah jual beli yang memenuhi syarat materil dan formil yang diatur oleh hukum tanah nasional. / Undue influence (Misbruik van Omstandigheden) is one of the motives that can be used to negate a contract. It occurs when there are parties who deliberately misuse the situations in agreement process. This condition will not affect the content of agreement, but it leads to abuse of free will. The elements contained in it have similarities and differences with other defects of will regulated in Burgerlijk Wetboek (BW). The purpose of this research is to find evidence of the components of undue influence which is enclosed in the debt agreement then be used as a land purchase contract. In addition to finding the evidence, this research also means to identify whether the procedure is in accordance with the ideal land purchase procedure according to Agrarian Law. This analysis uses a normative approach, where data sources obtained from secondary data consisting of primary, secondary and tertiary legal materials. The results have shown that proving whether an action accommodates fundamentals of undue influence (Misbruik van Omstandigheden) is by finding the evidence of the act that involves an element of position imbalance between the parties and examining whether the act limits the free will of one party. Furthermore, regarding to the legal land purchase agreement, it has to fulfills the requirements by Agrarian Law.
