Abstract

Penelitian hukum ini bertujuan untuk mengetahui pemanfaatan tanah di sempadan sungai menurut Undang-undang pokok Agraria dan Undang-Undang Penataan Ruang. Karena Pemanfaatan tanah di sempadan sungai masih banyak yang tidak sesuai dengan peraturan yang belaku. Pembangunan pemukiman di sempadan sungai marak terjadi, khusus nya di DKI Jakarta hal ini tentu melanggar Undang-undang maupun peraturan terkait tentang sempadan sungai. Pembangunan pemukiman di sempadan sungai dapat mengurangi fungsi sungai dan merusak ekosistem sungai karena limbah rumah tangga yang berlebih, dapat menyebabkan banjir, pencemaran air dan pencemaran lingkungan. Penelitian dengan metode yuridis normatif ini memiliki tujuan untuk mengetahui pemanfaatan tanah di sempadan sungai menurut Undang-undang pokok Agraria dan Undang-Undang Penataan Ruang. Peneliti sangat tertarik untuk mengambil judul Tesis sebagai berikut : “Analisis Yuridis Pemanfaatan Tanah Di Sempadan Sungai Menurut Undang-Undang Nomor 5 Tahun 1960 Tentang Dasar Pokok-Pokok Agraria Dan Undang-Undang Nomor 26 Tahun 2007 Tentang Penataan Ruang”. / This research aims to determine the use of land in the Riparian Zone according to the Law of Basic Agrarian Principal and The Law of Spatial Planning. Because there are still many lands uses in the riparian zone that are not in accordance with applicable regulations. The forbidden development in the riparian zone especially for housing and commerce is rife, especially in DKI Jakarta, this certainly violates the laws and regulation related to the river riparian zone. The development of settlements in the riparian zone can reduce the function of the river and damage the river ecosystem due to excess household waste, can cause flooding, water pollution and environmental pollution. The paper which researched in normative juridical method aims to determine the use of land in the riparian zone according to the Law of Basic Agrarian Principal and the Law of Spatial Planning. Researchers are very interested in taking the thesis title as follows: "Juridical Analysis of Land Utilization in Riparian Zone According to Law Number 5 of 1960 Concerning the Basic Agrarian Principles and Law Number 26 of 2007 concerning Spatial Planning"
