Penerbitan sertipikat yang merupakan alat bukti yang kuat bertujuan untuk memberikan jaminan kepastian hukum mengenai orang yang menjadi pemegang hak atas tanah, namun dalam pelaksanaannya masih saja terjadi sengketa mengenai kepemilikan hak atas tanah. Dalam penelitian ini bertujuan untuk mengetahui dan menganalisis kepastian hukum sertipikat tanah dalam sengketa tumpang tindih kepemilikan yang tidak diketahui keberadaan dan identitas pemiliknya berdasarkan pertimbangan hakim dalam Putusan Tata Usaha Negara No. 25/G/2018/PTUN-SRG dan dikaitkan dengan segi peraturan perundang-undangan yang berlaku. Hasil penelitian ini menggunakan metode penelitian yuridis normatif dengan pendekatan berdasarkan peraturan perundangan-undangan dan pendekatan kasus. Dari hasil penelitian ini menunjukan bahwa kepastian hukum dari subyek hukum terhadap kepemilikan pemilik Sertipikat Hak Milik No.1604/Kelurahan Cijoro atas nama Masun telah terdaftar dalam pembukuan Kantor Pertanahan Kabupaten Lebak berdasarkan proses pendaftaran yang sudah sesuai dan benar oleh karena itu sah menurut hukum. Adapun pertimbangan Hakim dalam memutus perkara Putusan Tata Usaha Negara No. 25/G/2018/PTUN-SRG tidak memperhatikan asas kepastian hukum mengenai kedudukan dari Sertipikat Hak Milik No. 1604/Kelurahan Cijoropasir atas nama Masun karena hakim dalam penerapannya berpendapat sertipikat tersebut cacat hukum adminstrasi. Dengan kesimpulan, Kantor Pertanahan Kabupaten Lebak belum dapat melaksanakan putusan Tata Usaha Negara untuk membatalkan sertipikat Hak Milik No. 1604/KelurahanCijoropasir sehingga kepastian hukum terhadap Sertipikat Hak Milik No. 1604/KelurahanCijoropasir atas nama Masun yang masih tercatat dan terdaftar di pembukuan Kantor Pertanahan Kabupaten Lebak masih mempunyai kekuatan hukum. / This study aims to determine and analyze the legal certainty of land certificates in overlapping ownership disputes where the existence and identity of the owner is unknown based on the judge's consideration in the case on state administration No. 25/G/2018/PTUN-SRG and related to the terms of the applicable laws and regulations. The results of this study use normative juridical research methods, and approaches based on legislation as well as case approaches. The results of this study indicate that the legal certainty of legal subjects to the ownership of the Certificate of Ownership No.1604/KelurahanCijoropasir in the name of Masun has been registered in the accounting office of the Lebak Regency Land Office based on the registration process that is already appropriate and correct and is therefore legally valid. The Judge's consideration in deciding the case for in the case on state administration No. 25/G/2018/PTUN-SRG does not pay attention to the principle of legal certainty regarding the position of Certificate of Ownership No. 1604/KelurahanCijoropasir on behalf of Masun because the judges in its implementation argue that the certificate is defective by administrative law. The conclusion is Lebak District Land Office has not been able to implement the state administration to cancel the Certificate of Ownership No. 1604/KelurahanCijoropasir so there is legal certainty for the Certificate of Ownership No. 1604/KelurahanCijoropasir of Masun which is still registered and recorded in the books of the Lebak District Land Office stil has legal force.
