Abstract

Kewenangan Notaris diatur dalam Undang-Undang Notaris yaitu Undang-Undang Nomor 2 Tahun 2014 tentang Perubahan Atas Undang-Undang Nomor 30 Tahun 2004 tentang Jabatan Notaris (“Undang-Undang Jabatan Notaris”), dimana kewenangan Utama dari notaris adalah membuat akta notariil. Dengan menjadi akta notariil maka akta tersebut menjadi sebuah akta otentik yang memiliki kekuatan pembuktian sempurna. Namun terkadang notaris dapat membuat kesalahan atas akta yang dibuatnya, sehingga Undang-Undang Jabatan Notaris juga mengatur kewenangan lain untuk notaris yang diatur pada Pasal 51 Undang-Undang Jabatan Notaris, yaitu notaris dapat dan berwenang untuk melakukan pembetulan atas akta yang salah. Pembetulan tersebut juga harus mengikuti tata cara yang diatur dalam Undang-Undang Jabatan Notaris yaitu dibuat dihadapan penghadap, saksi dan notaris dan dituang dalam berita acara. / Notary authority stipulated in Notary Law namely Law No. 2 of 2014 on the Amendment of Act No. 30 of 2004 concerning Notary ("Notary Law"), in which the top authority of the notary is a deed notarized. By becoming a notarial deed, the deed becomes an authentic deed which has the power of proof. But sometimes the notary can make mistakes on the deed he had done, so that the Notary Act also regulates other authority to notary regulated by Article 51 of Notary Law, the Notary can and are authorized to make a correction on the wrong deed. The correction must also follow the procedures regulated in the Law of Notary Position, which is made before confronters, witnesses and notaries and stated in the official report.
