Abstract

Ketentuan dalam Pasal 63 ayat (2) Undang-undang Nomor 2 Tahun 2014 tentang Perubahan Atas Undang-undang Nomor 30 Tahun 2004 tentang Jabatan Notaris (UUJN) mengatur bahwa berhentinya jabatan seseorang sebagai Notaris salah satunya disebabkan karena Notaris yang bersangkutan telah meninggal dunia, mengakibatkan segala tanggung jawabnya berakhir dan protokol-protokol Notaris yang bersangkutan harus segera diserahkan kepada Majelis Pengawas Daerah (MPD) melalui ahli warisnya untuk kemudian disimpan oleh Notaris Penerima Protokol yang telah ditunjuk oleh Majelis Pengawas Daerah (MPD) ataupun yang ditunjuk oleh ahli waris. Dalam penelitian ini, permasalahan yang diangkat adalah bagaimanakah tanggung jawab Majelis Pengawas Daerah (MPD) atas Peralihan Protokol Notaris setelah Notaris meninggal dunia. Bagaimanakah upaya hukum yang dapat dilakukan terhadap Protokol Notaris yang tidak ditemukan. Metode penelitian yang digunakan dalam tesis ini adalah yuridis normatif, jenis penelitian adalah kualitatif dengan menggunakan data sekunder, teknik pengumpulan data dilakukan dengan wawancara salah satu Majelis Pengawas Notaris dan menggunakan peraturan perundang-undangan sebagai bahan pendukung dalam melengkapi hasil penelitian. Dari hasil penelitian dapat disimpulkan bahwa tanggung jawab Majelis Pengawas Daerah (MPD) atas Protokol Notaris setelah Notaris meninggal dunia hanyalah sebatas menerima laporan dari ahli waris Notaris yang meninggal dunia dan kemudian menyerahkan Protokol Notaris kepada Notaris Penerima Protokol yang ditunjuk oleh Majelis Pengawas Daerah (MPD) atau ahli waris. Upaya hukum yang dapat dilakukan terhadap tidak ditemukannya dokumen/Protokol Notaris adalah membuat laporan kepolisian (LP). Bagi pihak yang merasa dirugikan dan/atau Ahli Waris Notaris yang meninggal dunia dapat membuat Laporan Polisi tersebut, untuk selanjutnya LP tersebut dapat diajukan ke instansi terkait sebagai bukti kehilangan. / Provisions in Article 63 paragraph (2) of Law Number 2 of 2014 concerning Amendments to Law Number 30 of 2004 concerning the Position of Notary Public stipulate that the termination of one's position as a Notary may be due to the fact that the Notary has passed away, caused all its’s responsibilities expiring and the protocols of the Notary must be immediately submitted to the Regional Supervisory Council (MPD) through their heirs to be kept by Notary Recipient Protocol who has been appointed by the Regional Supervisory Council (MPD) or appointed by their heirs. In this research, the issued is how the responsibility of the Regional Supervisory Council (MPD) for the transition Protocol Notary after the Notary passed away. How legal remedies can be used due to the Protocol Notary that was not found. The research method used in this thesis is juridical normative, the type of research is qualitative using secondary data, the data collection techniques conducted by interviews the Notary Supervisory Board and using the legislation as supporting material in completing the results of research. The results of the research it can be concluded that the responsibility of the Regional Supervisory Council (MPD) for the Protocol Notary after the Notary passed away is limited to receiving reports from the Notary’s heirs who passed away and then submitting the Protocol Notary to Notary Recipient Protocol who has been appointed by Regional Supervisory Council or their heirs. Legal remedies that can be used due to Protocol Notaris that was not found is making a Police Report (LP). For those who have loss and/or the Notary’s heirs who has passed away can make the Police Report, and then submit it to the relevant agency as evidance of loss.
