Tesis ini membahas mengenai pelaksanaan pengadaan tanah untuk pembangunan jalan tol Depok - antasari terdapat pemegang hak atas tanah yang menolak ganti kerugian dan tidak terjadi kesepakatan sehingga dengan alasan untuk kepentingan umum upaya terakhir dengan penitipan ganti kerugian di Pengadilan Negeri. Penelitian ini mengambil rumusan masalah mengenai penitipan ganti kerugian di Pengadilan Negeri untuk pembangunan jalan tol Depok - Antasari dan Putusan Pengadilan Tinggi Nomor 714/Pdt/2017/PT.DKI. Metode penelitian yang digunakan dalam penulisan ini adalah yuridis normatif karena menitikberatkan pada penelitian kepustakaan yang intinya meneliti asas-asas hukum, sistematis hukum dan sinkronisasi hukum dengan cara menganalisanya. Berdasarkan hasil penelitian, penitipan ganti kerugian di Pengadilan Negeri merupakan upaya alternatif terakhir penyelesaian pengadaan tanah jalan tol Depok – Antasari, penerapan penitipan ganti kerugian di Pengadilan Negeri tidak selaras dengan asas-asas perolehan tanah dan perlindungan hukum yang diberikan oleh hukum tanah nasional kepada para pemegang hak atas tanah dan Putusan Pengadilan Tinggi Nomor 714/Pdt/2017/PT.DKI menguatkan Putusan Pengadilan Negeri Jakarta Selatan Nomor 704/Pdt.G/2016/PN.Jkt.Sel tanggal 10 Mei 2017 dan penetapan penitipan ganti kerugian di Pengadilan Nomor 01/Eks.Cons/2016/Pdt/PN.Jkt.Sel tidak selaras dengan asas-asas perolehan tanah dan perlindungan hukum yang diberikan oleh hukum tanah nasional kepada para pemegang hak atas tanah. / This thesis discusses the implementation of land procurement for the construction of toll road in Depok - Antasari there is a land rights holder who refuses to compensate and does not occur so that the reason for the public interest last attempt with the care of indemnity in the District Court. This study took problems regarding the indemnity custody in the District Court for the construction of Depok-Antasari toll road and the verdict of High Court Number. 714/PDT/2017/PT.DKI. The research methods used in this writing are normative juridically because it focuses on literature research that essentially examines the principles of law, systematic law and the synchronization of laws by analysed them. Based on the results of the research, indemnity in the district court is the last alternative effort to settlement of Depok – Antasari toll Road land procurement, the application of indemnity storage in the district court is not in accordance with the principles of land acquisition and legal protection given by the national Land law to holders of land rights and the verdict of High Court number 714/PDT/2017/PT DKI strengthened the decision of South Jakarta District Court number 704/PDT. G/2016/PN. Jkt. Tue 10 May 2017 and the establishment of indemnity custody in court No. 01/Eks. Cons/2016/PDT/PN. Jkt. Sel is not in accordance with the principles of land acquisition and legal protection provided by the national Land law to holders of land rights.
