Abstract
Pada saat ini banyak PPAT yang terjerat perkara di Pengadilan dimana salah satunya adalah karena perbuatan melawan hukum. Dalam penelitian ini, PPAT terbukti telah melakukan perbuatan melawan hukum yaitu membuat Akta Jual Beli yang tidak sesuai dengan prosedur pembuatan akta PPAT, sehingga perbuatan tersebut melanggar ketentuan peraturan perundang-undangan serta melanggar kewajibannya sebagai PPAT. Pokok permasalahan yang akan dibahas yaitu perbuatan melawan hukum oleh PPAT dalam kasus pada Putusan Pengadilan No. 124/PDT.G/2017/PN.Jkt.Sel. Bentuk perbuatan melawan hukum yang dilakukan PPAT dalam kasus tersebut adalah melakukan pembuatan akta sebagai permufakatan jahat yang mengakibatkan sengketa pertanahan dan membuatkan akta dimana PPAT mengetahui para pihak yang berwenang melakukan perbuatan hukum tersebut atau kuasanya tidak hadir dihadapannya sehingga melanggar ketentuan Pasal 38 ayat (1) PP No. 24 Tahun 1997, maka Akta Jual Beli tersebut dinyatakan batal demi hukum dan akta tersebut dianggap tidak pernah ada. Dengan demikian, penerbitan Sertipikat Hak Milik Nomor 3747/Pondok Pinang adalah tidak sah dan pembebanan jaminan Hak Tanggungannya turut menjadi tidak sah serta tidak mempunyai kekuatan hukum mengikat antara para pihak. Berdasarkan ketentuan Pasal 62 PP No. 24 Tahun 1997 juncto Pasal 55 Peraturan KaBPN No. 1 Tahun 2006, PPAT tersebut dapat dikenakan penjatuhan sanksi administratif berupa pemberhentian dengan tidak hormat dan ganti rugi. / Nowadays many Land Titles Registrars (PPATs) are involved in cases in the Court where one of the causes is performing act against the law. In this study, PPATs were proven to have committed acts against the law, including issuing Deed of Sale and Purchase that is not in accordance with the procedures for making a PPAT deed. Therefore, the act violates the provisions of the legislation and their obligations as PPATs. The primary issue to be discussed is the act against the law performed by a PPAT in the case in Court Decision 124/PDT.G/2017/PN.Jkt.Sel. The form of the act against the law performed by the PPAT, in this case, was making a deed as an evil agreement which results in a land dispute and making a deed where the PPAT was aware that the authorized parties to carry out the legal act or their attorney were not present before the PPAT so that it violated the provisions of Article 38 paragraph (1) PP No. 24 of 1997. Therefore, the Deed of Sale and Purchase was declared null and void by law and it was considered not exist. Thus, the issuance of Freehold Title Number 3747/Pondok Pinang is illegal and the imposition of collateral of Mortgage Rights is also invalid and does not have binding legal force between the parties. According to the provisions of Article 62 PP No. 24 of 1997 in conjunction with Article 55 KaBPN Regulation No. 1 of 2006, the PPAT can be subject to the imposition of administrative sanctions of dishonourable discharge and compensation.
