Abstract

Setiap manusia pasti memiliki 3 (tiga) fase penting dalam kehidupannya, yaitu saat terjadinya kelahiran, perkawinan dan kematian. Saat seseorang mengalami kematian, tentunya ada harta yang tidak dapat dibawa dan harus ditinggalkan untuk anggota keluarga yang masih hidup. Di Indonesia, terdapat 3 (tiga) system waris, yaitu system Waris Islam untuk yang beragama Islam, system Waris Adat untuk masyarakat adat dan system waris Perdata atau system waris Barat. Dalam system waris Perdata, dikenal bagian mutlak (legitimie portie) yang berguna untuk melindungi bagian ahli waris. Dalam penelitian ini, pengumpulan data dilakukan dengan menggunakan pendekatan perundang-undangan dan pendekatan kasus. Terdapat kakak-beradik yang menuntut atas pembagian warisannya, karena salah satu pihak merasa bagian mutlaknya dilanggar. Adapun salah satu pihak pernah menerima hibah semasa hidupnya pewaris sehingga harus dibatalkan untuk memenuhi bagian legitimie portie. Hibah yang didefinisikan sebagai perjanjian harus dibatalkan sepihak agar dapat memenuhi hak ahli waris. / Every human being must have 3 (three) important phases in his life, namely the time of birth, marriage and death. When a person experiences death, surely there is a treasure that cannot be taken and must be left for living family members. In Indonesia, there are 3 (three) inheritance systems, namely the Islamic inheritance system for Muslims, the Customary inheritance system for indigenous peoples and the Civil or Western inheritance system. In the Civil inheritance system, known absolute part (legitimie portie) that is useful for protecting the heirs. In this study, data collection was carried out using a statutory approach and a case approach. There are brothers who demand the distribution of his inheritance, because one of the parties feels that an absolute part has been violated. One of the parties has received a grant during the lifetime of an heir so that it must be canceled to fulfill the legitimate part of Portie. Grants that are defined as agreements must be canceled unilaterally in order to fulfill the rights of heirs.
