Abstract

The Law enforcement to prevent crime is important because crime is damaging public safety and happiness. The sanctions for cases of rape of biological children by her father are very severe, capital punishment or chemical castration can be imposed on child rapists. Although the threat of severe punishment is imposed, in reality it does not guarantee maximum child protection. This research was conducted by examining the facts of cases of rape of biological children by her father through the discussion of Criminology. The criminological perspective of Sigmund Freud about psychoanalysis that the human personality commits a crime and perspective of Richard A. Cloward and Lloyd E. Ohlin thoughts Opportunity theory that crime occurs because of opportunity. The study also examined and compared two cases of rape of a child or biological father, known as incest under court decisions. This study uses a sociological research method which is a legal research method that functions to see the law in its true meaning and examine how law works in society. The conclusion of this study is, the phenomenon of biological child rape by biological father is the result of weakening selfunderstanding of understanding religious norms and moral norms in society. the weakening of the power of control in humans to suppress all bad deeds that are inappropriate in religious life and not in accordance with human morals, especially in the fight against sexual desires that are difficult to control.
