Abstract

Merek Terkenal memiliki peranan yang sangat penting di era modern ini, sehingga diperlukan adanya suatu perlindungan hukum terhadap merek terkenal yang telah didaftarkan. Terdapat adanya aspek perlindungan Kekayaan Intelektual pada negara - negara anggota dari Konvensi Paris atau World Trade Organization (WTO). Penulisan ini bertujuan untuk mengkaji secara lebih jelas mengenai perlindungan hukum terhadap merek terkenal berdasarkan prinsip first to file di Indonesia. Dandikaitkan dengan prinsip dasar yang ada dalam Undang-Undang Merek Indonesia yaitu first to file principle, bukan first to use, sehingga seseorang yang ingin memiliki hak atas merek harus melakukan pendaftaran. Pendaftaran terhadap merek perlu memperhatikan pasal 20 Undang-Undang No. 20 Tahun 2016 Tentang Merek dan Indikasi Geografis. Maka dari itu perlu ditemukannya permasalahan seperti, Bagaimana perlindungan hukum terhadap merek terkenal di Indonesia berdasarkan Undang-Undang No. 20 Tahun 2016 Tentang Merek dan Indikasi Geografis, Bagaimana pelaksanan perlindungan terhadap merek terkenal dalam Putusan Perkara Nomor 1105 K/Pdt.Sus-HKI/2018. / Well known trademark has in the important role in this modern era, so there is a necessary to having legal protection for registered well known trademark. There is an aspect of the protection of intellectual property as contracting state of Paris Convention about World Trade Organization (WTO). This research aims to analyzing Legal protection for well-known trademark pursuant first to file principle in Indonesia. According to fundamental principle in Regulation Number 20 of 2016 about Trademark and Geographic Indication (Trademark’s Law), that is a First to File principle (not first to use) as a terms for a person who wants to register their Trademark as mentioned to article 20 Trademark’s Law. Therefore, it is necessary to found the problem such as, how the legal protection for well-known trademark in Indonesia pursuant Trademark’s Law, how to protect well-known trademark in case number 1105 K/PDT.Sus-HKI/2018 as a research object.
