Skripsi ini pada pokoknya mengkaji tentang bagaimana perlindungan Hak atas Merek diterapkan di Indonesia. Hak atas Merek adalah salah satu hak fundamental dalam bidang Hak atas Kekayaan Intelektual dan merupakan hak yang sering dipermasalahkan dalam dunia perdagangan. Hal tersebut dibuktikan dengan banyaknya kasus yang terjadi, salah satunya adalah kasus mengenai hak eksklusif atas Merek coklat “Superman” antara DC Comics (sebagai penggugat) melawan PT. Marxing Fam Makmur (sebagai tergugat) (“Kasus Superman”) yang Penulis secara khusus bahas dalam Skripsi ini. Skripsi ini menggunakan pendekatan normatif dimana Penulis melakukan analisa atas seluruh peraturan perundang- undangan yang relevan dan berlaku terhadap Kasus Superman beserta dengan pendekatan yang diambil oleh m ajelis hakim dalam Kasus tersebut. Sebelum pembahasan Kasus Superman, Penulis akan membahas secara detil mengenai sistem dan prosedur perlindungan hak atas Merek pada umumnya dan bagaimana hal tersebut diterapkan di Indonesia berdasarkan peraturan perundang-undangan yang berlaku (antara lain, Undang-Undang No. 20 Tahun 2016 tentang Merek dan Indikasi Geografis dan Peraturan Menteri Hukum dan Hak Asasi Manusia No. 67 tahun 2016 tentang Pendaftaran Merek). Secara singkat, Hak atas Merek di Indonesia akan diberikan apabila Merek yang bersangkutan telah didaftarkan secara sah di Indonesia. Salah satu alasan penolakan atas pendaftaran Merek adalah jika Merek yang akan didaftarkan memiliki persamaan pada pokoknya atau keseluruhannya dengan Merek terkenal milik pihak lain. Hal tersebut merupakan dasar yang digunakan DC Comics dalam mengajukan gugatan pada Kasus Superman, dimana DC Comics berpendapat bahwa Merek “Superman” yang terdaftar atas nama PT. Marxing Fam Makmur adalah Merek terkenal milik DC Comics/ This thesis mainly examines how the protection of the Right to Mark is implemented in Indonesia. The Right to Trademark is one of the fundamental rights in the field of Intellectual Property Rights and is a right that is often questioned in world trade. This is evidenced by the many cases that have occurred, one of which is the case regarding the exclusive rights to the chocolate brand "Superman" between DC Comics (as the plaintiff) against PT. Marxing Fam Makmur (as defendant) ("Superman Case") which the author specifically discusses in this thesis. This thesis uses a normative approach in which the author analyzes all relevant and relevant regulations on the Superman case along with the approach taken by the judges in that case. Before discussing the Superman case, the author will discuss in detail the systems and procedures for protecting the rights of a Mark in general and how it is implemented in Indonesia based on applicable laws (among others, Law No. 20 of 2016 on Trademarks and Geographical Indications. and Regulation of the Minister of Law and Human Rights No. 67 of 2016 concerning Trademark Registration). In short, the Right to Trademark in Indonesia will give permission for a Mark that has legally registered in Indonesia. One of the reasons for objections to the registration of a Mark is if the Mark which is going to register is similar in substance or in total to a well-known Mark belonging to another party. This is the basis used by DC Comics in filing a lawsuit in the Superman case, where DC Comics argues that the “Superman” trademark is registered under the name of PT. Marxing Fam Makmur is a famous Brand belonging to DC Comics.
