Abstract

In Indonesian Intellectual Property Rights, logos are regulated in two different spheres. The first is in Law No.20 of 2016 concerning Trademarks and Geographical Indications and the second is in Law No.28 of 2014 concerning Copyright. In this thesis, one of the author's goals is to examine how logos are regulated in Indonesian regulations. The author has noticed that the logo regulation in Indonesia is unique because it has been regulated in two different regulations, namely the law discussed earlier. Another basis for this thesis is from the court decision in the case file no. 08 / Pdt-Sus / Copyright / 2016 / PN. Trade Jkt.Pst. dated February 2, 2016, regarding the case between Diesel vs Jemmy Wantono. In this case the issue of the case is the logo used for reasons of differentiating trade in goods but court proceedings are held within the scope of Copyright and decisions are made based on regulations from Law No.28 of 2014 concerning Copyright. The main research method used by the author in this thesis is a detailed analysis of the regulations that revolve around logos to find weaknesses and gaps in regulations to find sensible solutions to problems regarding logo regulation. For issues that have been taken from court decisions, the authors make an analysis of the court process and the rules used in the court process to find the answer to why the problem occurred in the first place which is then analyzed by the author to find a suitable solution. Through this method the authors discovered that because logo rules are unique and governed by two different sets of laws it is useful that logos have their own set of rules which can clear up confusion about where the different types of logos are governed. In this case, the authors found that the problem occurred from the registration stage regarding the logo and that there should be a stronger presence from the authorities regarding the monitoring of registered logos to ensure that there were no violations in the use of the logos that were already registered./ Di dalam Hak Kekayaan Intelektual Indonesia, logo diatur dalam dua lingkup yang berbeda. Yang pertama adalah dalam UU No.20 Tahun 2016 tentang Merek dan Indikasi Geografis dan yang kedua dalam UU No.28 Tahun 2014 tentang Hak Cipta. Dalam skripsi ini, salah satu tujuan penulis adalah untuk mengkaji bagaimana logo diatur dalam peraturan di Indonesia. Penulis telah memperhatikan bahwa peraturan logo di Indonesia adalah hal yang unik karena telah diatur dalam dua peraturan yang berbeda, yaitu undang-undang yang di bahas seblumnya. Dasar lain untuk skripsi tersebut adalah dari pihak keputusan pengadilan pada file kasus no. 08 / Pdt-Sus / Hak Cipta / 2016 / PN. Perdagangan Jkt.Pst. tertanggal 2 Februari 2016, mengenai kasus antara Diesel vs Jemmy Wantono. Dalam hal ini isu dari kasus tersebut adalah logo yang digunakan untuk alasan membedakan perdagangan barang tetapi proses pengadilan yang diadakan dalam lingkup Hak Cipta dan keputusan dibuat berdasarkan peraturan dari UU No.28 Tahun 2014 tentang Hak Cipta. Metode penilitian utama yang digunakan penulis dalam skripsi ini adalah analisa rinci tentang peraturan yang berputar di sekitar logo untuk menemukan kelemahan dan kesenjangan dalam peraturan untuk menemukan solusi yang masuk akal untuk masalah-masalah mengenai regulasi logo. Untuk isu yang telah diambil dari keputusan pengadilan, penulis membuat analisa tentang proses pengadilan dan peraturan yang digunakan dalam proses pengadilan untuk menemukan jawabn mengapa masalah terjadi di awal yang kemudian dianalisa oleh penulis untuk menemukan yang sesuai larutan. Melalui metode ini penulis menemukan bahwa karena peraturan logo adalah unik dan diatur dalam dua perangkat undang-undang yang berbeda maka akan bermanfaat bahwa logo memiliki perangkat peraturan-nya mereka sendiri yang dapat menghapus kebingungan tentang di mana berbagai jenis logo yang diatur. Dalam kasus ini, penulis menemukan bahwa masalah terjadi dari tahap pendaftaran mengenai logo dan bahwa harus ada kehadiran yang lebih kuat dari pihak berwenang mengenai pemantauan logo terdaftar untuk memastikan bahwa tidak ada pelanggaran dalam penggunaan logo yang sudah terdaftar.
