The purpose of this research is to know the regulation of international humanitarian law that give protection to member of the health service, and implementation related to the protection by international humanitarian law against member of the health service in the area of Palestine and Israel armed conflict in Gaza. Member of the health service are peoples who have special education in field of health, such as doctor, nurse, medical records and pharmacy. In order to fulfill humanitarian mission and protection of member of the health service is regulated in the Geneva Convention 1949 and Additional Protocol I 1977. The Geneva Convention 1949 is an international treaty that regulating civil protection in wartime and Additional Protocol I 1977 is an international Treaty to complement Geneva Convention 1949. This is related to humanitarian law. Humanitarian law is a set of rules based on international treaties and international customs based on international treaties that limit the power of belligerents in using their movement and their tool of war to solve conflict and regulating protection of war victims. As a conflict country, Palestine and Israel do not comply with the provisions of Geneva Convention 1949 and Additional Protocol I 1977, as providing legal protection to member of the health service is essential in order to maximize the humanitarian mission and minimize fatalities in war. Through this research, the Author tries to describe legal protection and the implementation in areas of Israel and Palestine conflict against members of the health service under the Geneva 1949 and Additional Protocol I 1977. international humanitarian law provides protection for members of the health service based on the 1949 Geneva convention and additional protocols 1977. But in fact in Gaza 2008-2009 there were still attacks on members of the health service and health facilities
