Abstract

The function of Trademark is not only used as a differentiator of a product, but also an invaluable company asset, especially for the brands that are well-known in the community. Although the brand has been arranged in such a way in the Act Brand, but still a lot of fraud and brand abuse by the perpetrators bad faith. It is unfortunate, that creativity is not only channeled for good intentions, but also for bad intentions, such as faking the original products by affixing, using original brands on counterfeit. At present the law of Trademarks in Indonesia has not explicitly explained and regulated about the well-known trademarks. Protection for well-known trademark is very important, considering that there are so many parties who have a bad faith. Regarding these matters, this research will analyze and review some regulation perspective of well-known trademarks protection under The International Convention and the latest brand legal protection in Indonesia regulated under order Act Number 20 of 2016 regarding Brand and Geographic Indication and explain the implementation of legal Trademarks in Indonesia, especially for the well-known mark of the Philip Stein brand that belongs to Philip Stein Holding, Inc. Based on the analysis, the authors disagree with the judge decision for not canceling the Philip Stein brand owned by Kasim Halim due to it having been proved of bad faith and proving the fame of Philip Stein Holding, Inc’s Philip Stein. Furthermore from authors perspective and analysis, Kasim Halim has been proven that he has a registered Trademark which had similarities in substance with Philip Stein Holding, Inc. brand, Philip Stein. With this inequity, the authors feel that the need for education to the community and the role of government to be more explicitly regulating regarding the provisions of brand protection in Indonesia.
