Abstract

The regulation on the Basic of AgrariaLaw (Undang-undang Pokok Agraria/UUPA) can be said at a forum for landowners, if a dispute occurs between other parties, the regulation is explained in detal regarding the handling of all the matters, in Article 33 Paragraph (3) of the 1945 Constitution. It said, “the earth, water, and natural resources contained in it are controlled by the state for use in prosperity”. The article explains how the state has given privilages to every citizen who wants to process or do something acout his/ her right. Settlement of intheritance disputes often occurs and result in disputes over inheritance right, habits that occur in the community where disputes in inheritance often arise because most are in dissatisfaction resulting in a dispute between you. These disputes included in unlawful actions where there are other people who feel they have a stretch of land and feel their own land and build a building that actually cannot get permission from the owner of the heir. The type of research used in this thesis is normative legal research. The nominative legal research itself can be said as a research for assessing the legal norm qualities itself by referring to the decision, the result of this study can be concluded that the dispute resolution mechanism carried out by the parties throught the court is based on the existence of losses for other parties who feel disadvantaged for what has been made by the parties concerned. So that the judge stated that the act should be called the Unlawful Act.
