The act of adopting children has been known since antiquity, even the adoption of children also varies in each region. Generally, the adoption of children is done because they have no children and as the successor of the lineage. Adoption is to lift or take the child of another person into his own child. The adoption of a child must be done by a legal process, namely through the determination of the court. The fact in Indonesia does not make the process of adoption in accordance with the procedure. The formulation of the problem in this thesis is How does the legal effect on the adoption of children is not in accordance with the laws and regulations in Indonesia (take example of Court Number 698 / PDt.P / 2015 / PN.Tng)? How is the position of adopted child in terms of Indonesian legislation (ex. Court ruling No. 698 / PDt.P / 2015 / PN.Tng) ?. In this legal research, normative juridical approach is done by library research. While the empirical juridical approach is done by conducting interviews with several sources namely the Commission of Child Protection Indonesia (KPAI) and Yayasan Putra Asih Tangerang. The results of the research in this thesis is the legal effect on the adoption of children who are not in accordance with the laws and regulations is the procedure becomes invalid, so that there is no legal certainty between adopted child with adoptive parents. Procedures for legally adopting children contained in Peraturan Pemerintah No 54/2007 concerning the implementation of adoption and the Regulation of the Minister of Social Affairs of the Republic of Indonesia No. 110 / Huk / 2009 on the Requirements for the Appointment of the Child. The position of the adopted child is based on the example of the court ruling number 698 / PDT.P / 2015 / PN.Tng, where the adoption of a child who has been adopted by the adoptive parent, the position of the child as an adopted child equal to the biological children which had stated on Undangundang No 35/2014 about Child Protection.
