This descriptive research discusses the judicial analysis of Buddha to Buddha case study, which the trademark was violated by Silver Utami. This research used normative legal research method with statute approach, using qualitative approach by analysing secondary legal materials. Human beings have borderless ability to innovate and create not only to earn a living, but also to create more efficiency in their daily activities to support and improve their lives. As the ethics and morals of businessmen are not utterly good, while "trade wars" continue to flourish in Indonesia. People will do everything in their favor to benefit from other people’s work. Note that the higher the intensity of people’s creations will further enhance economic growth, the country’s welfare and development. Indonesia is a civil law country and unequivocally relies on constitutionalism. However, the law development does not cover the violation of people’s rights. Therefore, the protection of Intellectual Property Rights as legal basis needs to be intensified, including through enhancement of public understanding and law enforcement officers. This study aims to examine the elements of brand violations and legal remedies that can be taken considering that the brand is a work of intellectual results that should be protected and valued.
