Land is the place where a human to live. Owning a land is necessesary to have a land area. Fact owning of land is Land Rights Certificate. When a human have a certificate of land, a human can make and build anything on his land. Build on land are regulate by law. Law regulate to someone to build was have to register and have a rights to build. The Rights to build is Surface Area building rights. Surface area building rights is one of the most important and mandatory documents that needs to be owned by every company who wants to build on a land surface. It is mentioned in the laws and regulations. Every company that specifically handle constructions must fulfill building rights requirements. Developers who don't own building rights are prohibited to build on their own land. Their obedience in fulfilling their obligation is an example of their own good will. In real life, many of the developers don't really pay attention carefully to the official procedures which often results in future controversy. Their negligence in this matter could cause major loss to the customers who intended to buy apartment units. the controversy itself can be individual or in group involving the developers and even other related parties. an example case of loss is on Supreme Court Decision Number 2979 K/Pdt./2011. In order to solve a controversial case between developers and apartment unit buyers, this research is done using analysis based on official laws and regulations like regulations regarding flats and other related regulations.
