Abstract

Penelitian ini membahas tentang tindakan eksploitasi terhadap anak yang berprofesi sebagai youtuber menurut Undang-Undang Nomor 17 Tahun 2016 tentang Perubahan Kedua Atas Undang-Undang Nomor 23 Tahun 2002 tentang Perlindungan Anak. Penelitian ini menggunakan tipe penelitian Yuridis Normatif dimana pengolahan bahan hukum dilakukan secara studi pustaka. Penelitian ini bertujuan pada pentingnya tanggung jawab hukum untuk melindungi hak anak dari pengeksploitasian ekonomi. Anak yang dilanggar haknya berhak mendapatkan perlindungan hukum karena perbuatan orang tua mereka yang memanfaatkan tenaga atau kemampuan anak oleh orang tua untuk mendapatkan keuntungan materiil. Orang tua bertanggungjawab akibat dari perbuatannya yang telah melanggar hak anak mereka dengan dipekerjakan sebagai seorang youtuber. Agar orang tua dapat dimintai pertanggungjawabannya, maka orang tua harus memenuhi unsur-unsur dari pengeksploitasian anak secara ekonomi dengan memanfaatkan kemampuan anak, adanya hak-hak anak yang tidak terpenuhi seperti beristirahat, bermain, belajar layaknya anak seusia mereka dan tidak menerima biaya kebutuhan dasar yang seharusnya merupakan kewajiban dari orang tua / This research examined the exploitation of children who work as YouTubers according to Act Number 17 of 2016 concerning The Second Amendment to Act Number 23 of 2002 concerning Child Protection. This research uses a type of Normative Juridical research in which the processing of legal materials is carried out in a literature study. This research aimed at the importance of legal responsibility to protect children's rights from economic exploitation. Children whose rights are violated are entitled to legal protection because of the actions of their parents who use the child's energy or abilities by parents to obtain material benefits. Parents are responsible for the consequences of their actions that violate their children's rights by being employed as a YouTuber. In order for parents to be held accountable, parents must meet the elements of economic exploitation of children by utilizing the abilities of children, the rights of children who are not fulfilled such as resting, playing, learning like children their age and do not receive the costs of basic needs that are should be an obligation of parents.
