Trade mark may be identified as pictures, names, words, letters, numbers, color composition, or a combination of the elements aforementioned which has a distinction significance utilized for commercial purposes. In implementation, there are still many cases that needs to be settle through court. The problem being discussed in this thesis is how does the law execute claim about trademark elimination based on law number 15 year 2001 on Trademark Law especially article 6. Also how ne bis in idem principle apply to continuous trademark claim. The method used in this scientific work is qualitative and juridical research. This study analyze current legal issues and relate them to regulations and applicable laws. Based on case number 57 PK/Pdt.Sus/2017, the plaintiff is GS YUASA Corporation who has registered the brand. The law suit filed against GOLD SHINE who’s re-registered the brand that has similar feature with the plaintiff’s. There had been a dispute back in 2006 along with a decision made by the judge through a case number 019 PK/Pdt.Sus/ 2007 that withdraw GOLD SHINE brand. GOLD SHINE, owned by the defendant should not be accepted when they re-registered because it has a very similar feature with GS YUASA and since GOLD SHINE re-registered the brand as a new one, ne bis in idem principle should not be applied.
