Marriage is a process of compromise between a man with a woman in forming a household of joyful and prosperous. Basically, marriage in indonesia is according to islamic law evenly distributed as monogamy. Polygamy is allowed with requirements in obtaining a permit of his wives. In fact that emerged in the community, marriage polygamy is not certain conditions determined in legislation, and led to the validity of marriage. Polygamy is a marriage between a man and two or more women, based on the Islamic Law (Al-Quran, Annisa 3 and Annisa 129) and Law No. 1/1974 on Marriage which states that a man can marry not more than four women. And this thesis was about a problem that is how arrangement marriage of a husband who do marriage polygamy for the second time without a permission from the first wife according to islamic law. The problems of the research were as follows: how about the regulation on polygamy in the perspective of the Islamic figh and Law No. 1/1974 on Marriage in Indonesia, how about the legality of the status of polygamy when your wife didn’t give a permission to polygamy. The research used judicial normative and descriptive analytic methods which was aimed to analyze legal provisions in marriage (Law No. 1/1974 on Marriage), KHI (Compilation of the Islamic Law), including the Islamic figh.
