Abstract
"Pemutusan Hubungan Kerja pada dasarnya dapat diartikan sebagai pengakhiran suatu hubungan kerja antara pekerja/buruh dengan pemberi kerja/pengusaha. Berakhirnya hubungan kerja sendiri juga otomatis mengakhiri suatu hak dan kewajiban yang berlaku selama adanya suatu hubungan kerja.
Tugas akhir ini bertujuan untuk mengetahui hal-hal yang harus dipenuhi oleh perusahaan pada saat melakukan PHK terhadap pekerja khususnya yang memenuhi taraf kesalahan berat sesuai dengan ketentuan dalam Undang - Undang No.13 Tahun 2003 tentang Ketenagakerjaan. Hasil analisis dalam tugas akhir ini menunjukkan, bahwa pihak pengusaha dalam hal ini PT. SBL melakukan PHK terhadap Pekerja X tanpa adanya tahapan serta prosedural - prosedural yang tepat dan tanpa penetapan dari lembaga penyelesaian perselisihan hubungan industrial. Dan upaya yang dapat dilakukan agar pekerja dapat mempertahankan kewajibannya.
/"Termination of an employment relationship can basically be interpreted as the termination of a working relationship between a worker / laborer and an employer / entrepreneur. The termination of an employment relationship also automatically terminates rights and obligations that apply as long as there is an employment relationship.
This final project aims to determine the things that must be fulfilled by when the company laid off workers, especially those who met the level of serious error in accordance with the provisions in Law No.13 of 2003 concerning Manpower. The results of the analysis in this final project show that the entrepreneur, in this case PT. SBL carried out the dismissal of Employee X without proper stages and procedures and without a stipulation from the industrial relations dispute settlement agency. And the efforts that can be made so that workers can maintain their obligations.
