Banking institutions play an important role in society because they can help the economy run well in realizing its function as an intermediary institution. Article 2 paragraph (3) Law of Bankruptcy and Suspension of Obligation for Payment of Debts give an authority to Bank Indonesia in submitting bankruptcy applications to bank debtors. Previously, the bank's regulatory and supervisory duties were at Bank Indonesia, but after the establishment of the Financial Services Authority, there was a transition in the regulation and supervision of banks currently in the Financial Services Authority. Thus it is necessary to conduct further research on whether when the bank's regulatory and supervisory functions are changed, it also influences the transition of bankruptcy applications to move to the Financial Services Authority, and how the coordination mechanism between Bank Indonesia and the Financial Services Authority in bankrupting a bank .The research method is a normative law because it uses a legal approach to examine more deeply about the regulations related to the transition of regulation and supervision of the banking sector as well as its correlation with bankruptcy requests by the relevant authorities before and after the establishment of the Financial Services Authority. The result shows that before the establishment of the FSA, the authority to submitting bankruptcy requests for permanent banks through Bank Indonesia was based on the provisions of Article 2 paragraph (3) Law of Bankruptcy and Suspension of Obligation for Payment of Debts, but after the establishment of the Financial Services Authority, the authority should be transferred to the Financial Services Authority, so it is necessary to make changes to the regulations on the authority to submit bankruptcy requests for banks so that legal certainty can be created for authorities who are entitled to file bankruptcy applications.
