Regulation of Agrarian and Spatial Planning/Head of National Land Agency No. 29 of 2016 was issued to trigger a new right associated with the right to use apartment, it is called Right to Use of Apartment Unit (RTUAU). To examine the accuracy within the regulation, it is necessary to conduct research on the regulation of the Right to Use of Apartment Unit which reviewed from the applies law and theoretical of regulated laws. This research constitutes the juridical normative research with the technical writing used is descriptive analytical. Futhermore, the result is outlined in the clear explanation, systematic and efficient to summaries a relevant conclusion. It is also supported with the secondary data collected with the method of literature study. Based on the result, it concludes that the provisions stipulated within Ministerial Regulation are contrary to Act No. 20 of 2011 on Apartments, Act No. 5 of 1960 on Basic Agrarian Regulations and Act No. 12 of 2011 on Establishment of Regulation, it is also contrary with the theory of Law Regulation expressed by Hans Kelsen and Hans Nawiasky. Despite of the contrary, RTUAU still applies as the positive law in Indonesia if there is no new regulation covered it up or court decision to cancel it.
