This study examines the implementation of Law No. 30 year 2000 concerning Trade Secrets, based on the court case of leaking tender documents as decided by the Supreme Court decision No. 783K/Pid.Sus/2008. The analyze focus on the arrangements regarding the protection and mechanism of trade secret dispute resolution in Indonesia. By using the normative legal research, this study found that arrangements regarding the protection of Trade Secrets have been regulated in Law No. 30 year 2000 on Trade Secrets, as well as the Criminal Code, Civil Code, Labor Law, and Ministerial Degree of Manpower No. 150/Men/2000. In evaluating the effectiveness of Law No 30 year 2000, it can be reviewed based on three aspects, namely substance which is no longer sufficient, as seen from sanctions that are too lightly regulated in the act. Likewise, the legal structure or the government that runs it does not foster justice so that it has an impact on the legal culture in the community. They tend to underestimates the Law and has no fear of leaking the trade secret. Based on this conclusion, it is suggested that the government amend the law to accommodate such concerns and disseminate the law to public.
