Trade mark may be identified as pictures, names, words, letters, numbers, color composition, or a combination of the elements aforementioned which has a distinction significance utilized for commercial purposes. Trademark is also utilized by the consumer to identify the producer of a product or service. The problem being discussed in this thesis is how does the law regulates for brands that are unable to be registered specifically because it possess a meaning or it is the goods or services itself to be applied for the trademark registration and identifying the principle of good faith in the cancellation of a Brand based on Law number 15 year 2001 on Trademark Law. A registered trademark can be filed to cancelation by a party of interest through submitting a lawsuit to the Commercial Court as shown in Decision Number 880 K/Pdt.Sus-HKI/2016. In this case, the defendant Indra Nusantara register the brand MICROFIBER for goods in class 20 in the form of pillows made of micro fiber, bolster made of micro fiber, spring bed made of micro fiber, and beds made of micro fiber. The Plaintiff is PT Cipta Kreasindo Gracia who has previously registered the brand The Luxe for and produce goods made from microfiber material. The lawsuit filed againts Indra Nusantara intends to test whether the MICROFIBER brand D09.2015.002964 Is the same in substance with the mark The Luxe owned by the Plaintiff and should not be accepted because it is descriptive in nature where microfiber is the raw material of pillow, mattress and etc. The method used in this scientific work is qualitative and juridical research. This study will analyze current legal issues and relate them to applicable laws and regulations.
